I took in the max to the dealership to check out my cat converter because of a sulfur smell and they told me that they might have to charge me $110 for them to look at it. I have a 01 with 17K miles, I should not get charged for them to look at my car correct? Should I contact Nissan Customer Care?

Well, in this case you should pay nothing. Even if you are out of the 3 year warranty, the cat is still covered under the emissions warranty.

If they find a problem, you should not be charged anything. Your warranty covers things like that.
However, if they don't find a problem you can be charged. Some dealers may let you slide, but some won't. To a dealer, inspection work is considered labor, so if you brought in a car for them to look at and nothing turns up, you've essentially used up their 'valuable' time and resources. Billing time.
