Brake lights are designed to work without the ignition key being in the switch, so that is normal.
And then, are you sure you changed the brake light switch and not the cruise control disengage switch?
What you want to look for is a plastic "bumper" on the brake pedal arm that touches the switch to make it work, part # 46584-5P010.

Yes, that plastic bumper (labeled "Stoppers" in the picture) can fall off. When the brake pedal is NOT depressed, the bumper keeps a "piston" that comes out of the switch from sticking out of its chamber, preventing the stop light from being activated. As you depress the brake pedal, the bumper, which sits along the brake pedal arm, moves away from the switch, allowing the piston to come out and turning your brake lights on. If the bumper is not there, the piston doesn't have anything to stop it and your brake lights will be on all the time. Your battery will drained pretty soon.
