I am lost as to whether he thinks parts were swapped or not. First he said the replacement engine was clean and shiny and his was dirty etc and still dirty. So he thinks the motor was not swapped.
Now he is saying that the parts on the motor are dirty etc and his were clean.....
When we do a used motor ( we don't like to do) we swap known working parts over. Intake, distributors, throttles, etc. We suggest resealing the engine; valve cover, rear main, crank, etc.

Even my wife calls BS on this. She thinks plane crash was in jail. Or the psych hospital. "Those are the only two things that would keep you away from technology and would be ashamed of."

Small claims is the way it looks we will be going if he doesn't give me a call tomorrow working everything out. He doesn't seem like he wants to fix it. And is being very shady.
He showed me an engine with 85K. It was in perfect condition.
The engine in my car is not the one I was shown. They look completely different and my girlfriend is my witness, she saw both engines.
He kept the shiny engine for himself, and gave me a different UIM and fuel rail to create the illusion it was a different engine (when it is the same engine)
Either way, no matter what he says, the engine currently in my car is defective and I can replicate and prove it at any time.
I paid all this money to fix the worn VTC's.. and they are STILL broken.
I get the cold start clatter in the timing chain area
I get timing chain pops/noise as the oil pressure bleeds off (when car is off)
I get the flickering oil light upon first engine start (oil pressure bleeds out of VTC)
I have owned 2 maximas with the same engine. My old maxima did not do ANY of the items I listed.
This is unacceptable and im not having it.

First you said the new motor was new and shiny. no rust, no discoloration. Now you say you have dirty parts on your car that were not dirty before. So are you saying he bought a 3rd engine and put the dirty parts on your car since the supposed new engine was new and shiny and you don't have shiny parts and also have parts that were dirtier than yours?
Man I hope you go to court and he is found not guilty. Hopefully you get to pay his court and attorney costs.

wow I have seen some people who lack common sense and have done stupid things but you top all of them... why would you even consider putting an engine in a car that is over 10+ years old and there are a ton of those on the internet... for the price you paid you could have picked up the 3.0 or the vq30dek 5th gen maxima and move on with your life... I am sorry but putting close to $4000 in a car that's not worth that is just pure stupidity and you deserve it... so stop crying cut your losses and move on with your life... you got scammed... welcome to CT as you would say... I am pretty sure hundreds of people got scammed today in CT...
Want a real advice? Talk to a financial adviser next time you have an extra $4000 to spare... there sure a lot more reasonable ways to invest the money that put them in an old Nissan just so you can come back to the forum and brag about what kind of stupid move you made...

Dam OP, what were you thinking? You're poor and sloppily spending 3k on a swap without even covering your own **** or doing a bit of research on this guy? Regardless, cover your **** when it comes to your own money. Thta's inexcusable at any age.

I think it sounds par for the course for plane crash. The easy thing to do would be for him to show you the old engine. Geez, how hard is that. Most shops keep the old engine around for a bit.
And for all that is sane, yes - the engines are going to look nearly indistinguishable. These engines also tend to rust in the same areas, so to pop the hood and say it looks the same should be right, NOT wrong!

Consists of cylinder block fitted with pistons, rings, connecting rods, crankshaft and all bearings, cylinder head, camshaft, timing chain or belt and/or sprockets. Includes: Clean and transfer fuel and electrical assemblies, engine mounts, manifolds, valve covers, oil pan, oil pump, timing cover, water pump, clutch assembly and flywheel. Adjust idle speed, timing and valves where applicable.
Avg labor cost of $100.00 per hour and that is $2000 right there.
I see motors in the $1200.00 range. So they probably charged around 14 hours of labor or so and marked up the engine a fair amount to get to $3000

I have after 6 months, gotten my maxima back! I just wanted to say hi to this warm loving community again.
The timing chain tensioner and water pump were both shot on the old engine, and it threw the timing off causing a constant tick at all RPMs
I paid $3260 total for an engine swap with an engine with 85K miles.
I'm not sure the guy even changed the engine.. it looks identical, rust and discoloration in exact same places on the timing cover.. but it is clear they did reseal the cover (RTV is different color). Im gonna peek for the vin tomorrow.
Anyways, im just thrilled to have my baby back.
I was driving a saturn ls1 with 454,000K miles for the past few months. No ebrake, bucks under acceleration, ect.

it just amazes me the stupidity of some people in this world. i would've marked the engine in a few spots, taken pictures of the old and new vq so there would be no question in my mind that the job was done. christ, i have a 251,000 mile 95 with engine chatter and a leaking timing cover and would'nt pay more than 2,000 to swap, no way. he took advantage of you cause you obviously did'nt go in prepared and did'nt know what you were doing.
