Maxima 5spd = Careless Driving

Well, sortof.... I got a ticket for careless driving tonight. Situation: 5spd Maxima sitting at a stop sign waiting with blinker on to turn right. Gets a small break in traffic so gets in the right lane and runs through 1st and 2nd (half through second) gear getting up to the posted speed limit (45mph). Cop pulls up behind with lights on. States it was careless driving. Blinkers were used, tires were not squealed, no speed limits were broken, and no quick lane changes were made. (Cop agees to all of the listed) Just brisk acceleration to the speed limit in order to not impede traffic!! Nothing on my record, and if I plead guilty I can probably get it retired, but I just don't feel that guilty.

Next car will be an automagic

dude thats jacked up I've heard of it happening before though... good luck with whatever you choose... sux to be a victim

but next time... dont buy an auto you'll just have to drive harder not to impede traffic...

If I had known I was going to get a ticket for this, I would have at least smoked first and chirped second!! Then I wouldn't feel so cheated!! lol Its not even the money that bothers me. Just like getting a ticket for driving with your headlights on before its dark enough.

Time for shocks and struts I guess. That way the squatting between gears will be less noticable.

The only funny thing about this was my girlfriend's reaction when the cop stated I was getting a ticket for careless driving. She gave him some lip lol "He stoped at the stop sign, used his blinker, didn't even change lanes, didn't go over the speed limit, and didn't squeal his tires. What the Hell?! Is it a slow night for you or what?" At that moment I started laughing, but stopped soon as he said you need to sign here!

he can't ticket you for accelerating fast...because you stayed under the speed limit and you were safe doing it. You didn't break traction...i don't get what the ticket is for...If there was a posted acceleration limit and the officer told you you were accelerating over the limit...then guilty....till then, innocent

Yeah, I feel it should have been a warning or something? How do you plead? "Guilty because I want it off my record, but this is @#$$ing horse s#$#!" Think that will work?

Just plead NOT GUILTY and leave the burden of proof to the officer. He might, having seen that you've actually shown up for court, offer you a lesser charge without points to your license. The fact is, you weren't speeding.

pleade not guilty. this stupid offense is called "jack rabbiting" i got pulled over for it once. they consider accelerating to fast to the posted speed limit is "jack rabbiting" but the thing is that theres no real way to prove this, its the cops judgement, and you cant actually write a ticket for "jack rabbiting" so most cops will write it under neglagent driving. i got off with a warning and if i were u i would pleade not guilty, whos to say the cops judgement is good enough to tell that you were accelerating to fast when u didnt sqeal the tires.... i know this may sound weird but its true my aunt is a sherrif

I agree with 'dwapenyi'. plead NOT GUILY, then show the judge a copy of the Fuel Cut TSB and say it's Nissan fault.

In my state this could be put down as exhibition of speed, reckless driving, or innatentive driving. The hypothetical problem is that under full bore acceleration, a person's reaction time may be slower if a vehicle pulls out from a side street or a driveway. You couldn't immagine a Calloway Corvette running WOT to 45 mph on a city street could you? Sure, that car is MUCH faster but the principal still applies.

That said, I think the TICKET is lame! Could be used for PC to make a stop, but citing you for that.....

You have nothing to lose from fighting it. Don't plead on this one, when the officer acquieses that you were traveling under the speed limit, did not squeel tires (wreckless), and blinkers were used, the judge will likely reprimand the officer for wasting his time...

Absolutely nothing. It's about cops handing out careless driving tickets whenever they feel like it. Same exact thing happened to me before. Didn't break the speed limit, and didn't break traction, signals were on. Something like this worth 2 points and a couple hundred bucks? I think not. What really sucks is after you plead your case, you and the judge will both know that this is a bullsh!t ticket, but no matter what you will still end up paying something. Just hope that it will get reduced to something much, much cheaper. I forget what mine was reduced to, but he will definetly drop the points. Because it is so vague, they can write you this ticket anytime they can't cite you for something specific. In NJ this ticket will cover everything from gassing it to talking on your cell. Just so you know it happens to autos too .

5spd = play through gears more often = stupid tickets.... well in this situation at least


However, I do feel if I had been in my old auto max that this ticket would have never been given!

Having your girlfriend as your witness will help you a lot in court. I have heard of cops getting in trouble with the judge for giving false tickets before due to the testimony of a witness. Pleading guilty seems like a bad idea. If anything, you can plead no contest, if you don't want to fight in court.

Pleading no contest? So not saying that I am guilty, but just saying I don't want to contest it? Then he would probably just give me the ticket if he didn't here my side right? I know the style of this judge. He is a ***** too!

Girlfriend will be coming as well!

Its nice to see a point of view from the "other side" of the coin. I often wonder how people do or do not get pulled over. I have followed a couple of your posts and get a better idea. I like how you explain the "whole story". Thanks.

I still get the cold sweats when I see one of your fellow employees pull in behind me with cars similiar to your "other" car. Whether I did anything or not! LOL

I too still get that pit in my stomach when I see the lightbar in the rear view. Worse still if one is lit up in my rearview...I don't think it ever goes away. My father in law retired from the Idaho State Police after 32 years and he STILL feels that way!

I am considering another 4th Gen. Maxima SE 5 speed. The other two cars in the running are a 4th Gen. Prelude VTEC and a Porsche 928 S4 or GTS. The Maxima stands the best chance, just have to find the right one. If you decide to sell it, let me know.

Ever since the MEVI numbers started rolling out I am finding new interest in my car though.

If they just made an ECU upgrade for a 97 plus........

***UPDATE***

Went to court this morning and here is what happened:

Judge says. "How do you plea?"

I say, "No contest" ---- would have said not guilty, but then they would have given me a new court date.

Jude says, "What do you have to say?"

I state the facts as I listed in my firt post....

He says, " I will retire the ticket for court cost." $40

I say, "Thank you."

If I would have said guilty I would have gotten community serice and fined $60.

Anyway, my record is still clean, end of story!!!

yes, whenever you go to court, the people there do all kinds of bs to make you pay whatever they cannot make up with their tax.

$40 is nothing...but I know you are innocent. It's the usual bs going on in bureacracy.
