Accident: Legal Help Needed...

Not me, but my bud with a 2000 Maxima got into an accident. At night, he tried to switch lanes on the interstate, saw a car and turned back (too sharply possible) when the rear of his Max spun out... hit a divider, spun across the highway and hit the other. Airbags deployed of course and over $7k worth of damage. Luckily he did not hit anyone else, and even luckier he walked out with only a bruised face form the airbag and a strained rib.

Anyways the officer said that he was "Unable to Control his Vehicle" and hence gave him a Wreckless Driving ticket. So basically my question is, is the officer able to judge his control of the vehicle? Is that grounds for a case? He was not intoxicated at all, wearing his glasses and seatbelt.

Thanks for the link guys, but I'm sure somebody here will know the answer to the question. Even though the All-Mighty Sprite doesnt.

when you get in an accident.. you can get slapped with a "travelling to fast for conditions ticket" .. and it will hold up in court easily.. and based on the account you gave.. the officer is right.. your friend was "travelling too fast for conditions" so basically he is screwed.. that ticket will stick like flies on ****..

Thanks bud, I knew you would know. I will tell him to sign up, I hope he does for $27 or whatever it costs.

Plead not guilty to the ticket, the cop will have to articulate why he gave you the ticket. Most time, accident tickets are dismissed or pleaded down to a less charge if there is no witness to the accident.
