so I talked to the insurance company today...

After the Oak fell on my max, I hear from the guy who does my body work he tells me that the adjuster came looked at my car and didn't even bother to look under the car!!! They quoted $7000 worth of damage and that's with using aftermarket generic parts...man was I ****ed. I was really hoping that I could total it out and start over.
I called the insurance company and they gave me the run-a-round and said that if there was more damage after they started working on it they would fix it So now I'm in a war with them, they have to cut the roof off and replace it and the driver door, reset the driver back door and they said that even though the firewall was damaged they would just push it back and "not worry about it". So then the lady tells me it could be worse that her son got hit in her NEW S500 mercedes and had 28 grand worth of damage.....Yeah insurance pays in never pays out. Long story short It's gonna take atleast two weeks to get the money and 3 months to get it fixed and they can't even promise me that it will be as good as new.....Sorry for the long thread but I had to vent......to top it off I told my girfriend and she says "Yeah, that's ruff but it's just a car, you will get used to it"

Girlfriends just don't understand!!

Dude that is a damn shame.. I would ask the owner of the company who took out the oak tree to somehow compensate you, explain to them that you will make their lives very unhappy and unpleasant if they don't help you out..

then if they don't get online on all the landscaping sites and post bad words about them..

I cleared the tree off myself....and It was on my property....and my house insurance doesn't cover damage done by acts of God to other property. It boils down to this.....God hates me and loves to watch me sqirm.....oh yeah I got my parents to loan my their old Explorer and I drove it 2 days and the tranny has a severe leak and now I'm left bumming rides and walking.....I failed my calculus test and I'm losing my mind

what insurance co is giving you the run around?

btw, the body shop knows more about the safety of a car with a replaced roof and firewall.. you should be asking them, not the adjuster/rep.

There is no way that car will ever be right. I had a light pole drop on a honda I used to have. It flattened the A-piller, hood and fenders. $4000-ish. The car was straight but I had alot of wind noise and creaks.

Sorry to hear this had to happen to your whip. Especially since it is a 2k3. Anyway, I agree with maxcosity...you should go after the company that cut the tree down. Not to sure about the karma thing but at least you were not in the car.

I hear ya 1000% dude..I had a 2000 Hyundai Sonata which was stolen from me while I was in a store (long story)...anyway the little 15yr old ***** had the car for a week joyriding in it, smoking in it, you name it....well to make a long story short, he (for reasons still unknown) cut my sunroof out, yeah he actually cut the friggin thing out amongst other things. Well the car was worth $14k and the damage totalled $12k, the insurance STILL repaired it, which involved REPLACING THE ENTIRE ROOF including sunroof and other things.

After all was said and done, car was never the same and I traded it in on my 02 Altima that I had prior to this Maxima.

Insurance cos.....go figure with them...you would think they'd try and save a buck and just find me another Sonata, but no they wanted to repair mine and then had the nerve to jack my rates up upon renewal.

Hey dude, sorry to hear about your car but you need to look into this new law, or law in works.
Insurance companies now are obligated to pay the difference of the value of the car. Suppose in your case the car was worth $20,000 before the reck, and after the insurance company fixes it, the value of the car is $12,000 (and it will drop by that much of a different with that amount of damage), the insurance company has to pay you an amount that will take care of that difference so that in case when you sell your car, you will not loose.
Now i am not sure if this law is in effect yet, but i've read about it somewhere and it should help. I think i read it on this board. If you have that handy, you can basically get the insurance company to total it. If they do, make sure you try to buy it back. It'll be hella cheap then.

Umm Guys...the way I read his earlier post...The tree fell on his car...no "company" cut it down.

I only have a $15.00 a day coverage on rental cars and the cheapest is like $25.00 a day and that is only good for 30 days and it's gonna take alot more time than that. I just got back from the body shop and talked to the adjusters What a couple of pompus A$$es they were. They were telling my body guy who has 30 years experience and a good friend that he didn't know what he was talking about, I thought for sure he was start swinging. Personally I don't trust anyone who has never done body work themselves. They offered 7 grand to cover damages and would see once it got into the frame shop...my guy says that he'll be able to find at least another 3 grand of problems. What I'm hoping that if I worry the Sh@t out of them that they will pay off and I could sell it as is 12-13 grand I've had a couple of offers.....Then I could go look at the G35

Whats the story with how the tree fell? Was it god or was it human? I didn't see the other post.

That new "law" sounds a little too good to be true. Isn't paying out that difference on top of covering repairs equivalent to totalling the car? In either case, the insurance co. pays out the same amount (either bulk amount in case of total loss, or pays off a certain percentage for repairs, and the rest is compensation, but totalling the same "bulk" amount).

Tarpoon: Sorry to hear about this issue. I definitely hope that you get it resolved to your accord. I suggest to keep fighting with the insurance company, and ask your body shop friend to write up more damage, hopefully adding enough so that ins. co. will think about writing it off as "total loss".

What ins. co. is this? I will be looking for a new one right now that serves the MASS area cause I'm getting fed up with my current one.

It's Nation Wide they are on YOUR side.....not

So far it's been about what I expected....hassle.... at least in
N.C. you have to reach 75% of the value to total the car. What I'm hoping for is sell as is for 12-13 grand get the repair money pay it off and start over
