!! My MAX got Rear Ended, need Advise!!

Guys ... Yesterday was my Birthday ... and on the way to dinner ... guess what?


Some guy in a Honda CRV Rear Ended me at an intersection!!
I was making a Righthand turn on a Red light, and I stopped to check.
When suddenly BAM ... My car was Hit from the Back!



Got all of his Info, but he had to leave. I went to the collision centre with the Friend in my car, and my friends that arrived!


After Filing a report at the collision centre, the estimate damage was $3000!

My rear BUMPER is all scratched up.
There's a 3 Inch cut/slit in the centre (most likely from his Licence Plate)
The lower part of my Trunk lid is also Dented/Bucked.
The Trunk Lid is now slightly lifted, I can fit my fingers in the Gap between the Lid and my car!


Now the Guy offered me to pay Cash! BUT I doubt he will pay me $3000+ in cash!

As well, my friend in the car has whiplash, she's taking One week off work!

This pretty much decides that I have to claim insurace, doesn't it? Cuz she will not be able to get physio unless I clain right?


What's your take on this guys?

I doubt you can get money for the whiplash thing unless you go through insurance, which will then hick up your payments. $3000 sounds like a lot for trunk lid/bumper/paint repair dont you think? NO matter, at least no one got hurt too bad, happy birthday again if you didnt see the thread.

Him getting hit will not make his rates go up... In order to get compensation for the whiplash it would be necessary to go through insurance unless the guy is gonna pay for it in cash. I would contact his insurance and go from there.

If the damage was just a scratch on your bumper you could do him the favor and take the cash offer. Although for what really happened that is not an option. You need to report it to the insurance company and let them make sure that his insurance company pays for it. Also there is no way that his cash would pay for the damage to the vehicle and whatever medical cost that could arise from the whiplash or compensate her for taking off a week from work to recover from the accident. Let his insurance take care of the accident, that's what we pays them for.

Don't ever take any BS from anyone. You should have gotten a police report immediately.

Also, concerning your friend, you should have gone to the ER ASAP. Don't wait for those medical assessments. Good luck in court!

I don't know how things are there but if I were you I'd call the guy's insurance, not yours. If he admits fault usually you don't even have to go through your own insurance. Good luck.

Yeah, you should have called the police and filed a police report on the scene. The same thing happened to me about 8 years ago. A guy rear ended me, scratched the bumper up and caused about $800 in damage. Anyway, I got his information and he apologized multiple times for hitting me while admiting it was is fault. When I went to file the claim, the dude's insurance company refused to cover it because the guy changed his story about what happened. I really wanted to hurt him bad. It was basically my story against his with no police report. In the end I got screwed. Now no matter what happens, even if it's a minor collision, I call the police and file a report on the scene. The report makes all the difference and takes a lot of hassle out dealing with insurance companies. Good luck with your predicament.

Yeah it would be kinda of tough since your friend got whiplash, and is taking a weeks off of work, all depends on the guy. If I were you I would go call insurance and let them take care of it.

I would go through insurance on this without even thinking. This is 100% his fault and if your insurance should not go up. When I was 14 years old I was involved in a 3 car collision because of some teenager and I got a neck injury which was identified through an MRI but nothing too serious. I got 22,000 from the lawsuit. Get a police report and call your insurance company right away.
