Is VIN required on traffic ticket

My wife today got a traffic ticket for not having a seat belt put on our 13 year old son who is 135 pounds and was sitting in the back seat of the car. The ticket does not have a VIN. Can this lead to dismissal of the ticket?

I doubt it. More than likely, the ticket should have your make, model, color of your car, license plate number, name and address. This should be enough information to track you, if needed.

go and buy your district DA a dinner and slowly talk him into dismissing the ticket. That way the cop would just stfu. I always hire my lawyer to do that. It's 250/pop.

...Or you make your son pay for the ticket for not wearing his seat belt - no harm on you or your wife.

Spend $250 to get out of a $65 ticket.

Pay the fine and make sure your son is always buckled in.

Well, my wife always tells my son to put on the seat belt. But you know how teenagers are, my son sometimes unbuckles the belt (without letting my wife know since she is busy driving) because he thinks it is a physical restraint and does not look cool.

When my wife stopped at a red light the other day, which happened to be, unfortunately, right in front of a police station, she was given a ticket. I just learned that she already paid the ticket ($40 fine plus $50 surcharge).

In New York, everyone under 16 has to be buckled in, even sitting in the back seat and no matter how tall and heavy you are, unless you can show, with a doctor's certification, that buckling in may actually cause a physical harm to the passenger or is otherwise physically impossible. I don't know how old this law is, but it appears to have been written within the last couple of years and many people are not aware of this. Is this also the law in other states? BTW, my son tells me that no one buckles in on the school bus. Go figure!!

BTW, New York law also says that no one under 16 can sit in the front even with the seat belt on. What happens if your car is only a 2 seater, stuff your teenager in the trunk? I drove to Virginia last year and I asked my son to sit in the front (of course with the seat belt on) because I needed him to help me with street signs and directions. We actually stopped and asked a police officer for directions, but he didn't have a problem with my son sitting in the front. What is the deal with New York?

May be I didn't make myself clear ... in NY, you cannot sit in the front when you are less than 17, even if you wear in seat belt. Also, everyone sitting in the front must have a seat belt, but when you are less than 17, you must also wear a belt even when you sit in the back. I think the law is written poorly ... as I noted, what if you only have a 2 seater.

If you only have a two seater you should not be ticketed. There should be some flexibility in that law.

Damn dude, just make your rebellious son take the hit to the pocket. Someday he'll learn that you can't be cool, and BROKE at the same time. Why wouldn't you make him pay that ticket?

Make your kid pay the ticket. He is 100% responsible for it.

No the ticket is not going to be dismissed, I've never heard of a vin # on a ticket and I've gotten alot of tickets over the years.

Seriously, +1 for kid covering the ticket, or at least the actual fine, $90 may be a bit much for his age. Teach him a little lesson. I never once forgot to wear my seatbelt as a kid, how is it "not cool?" Probably less cool when your brains are all over the pavement, let him know that.

Man, I feel weird being 18 and being the first to tell the original poster that it's his kids responsiblity. I lost two of my friends (seperate accidents) because of their choice to not wear a seatbelt. This isn't a joke. But since he is young, he won't think that far into the situation. But when he reaches for his wallet, and realizes that the new videogame he wanted to buy was out of his reach because he wanted to be cool in a car (with his mother no less...) he might get it through is head.

If he doesn't have the funds, set up a payment/chore plan where every hour is worth a measely 5 dollars, or something like that.

Just shows that you have learned some of life's lessons and gathered some wisdom. You are on a good track with your way of thinking BigLou.

Man, the buses I've been in (even the charter ones) have never ever had seatbelts! When I lived in the Midwest/SW, and the states first enacted their seatbelt laws, they even made a special exclusion for school buses. Their excuse was that it would slow down the routes too much if the driver had to wait for the kids to un/buckle up. I remember the lt. gov. saying on TV that the backs of school bus seats are very well padded, so that was good enough protection. How messed up is that? But then again, that was back in the 80's, when there was a lot of resistance to seatbelts and people thought the risk of being burned alive in your car outweighed the risk of being thrown through the windshield. I think that mentality has been reversed with the public safety campaigns. Thank goodness.

No one under 17 at all in the front? bullsh!t law how could they pull that off, unless its either NEVER enforced or BRAND new- ive been riding around with my mom since i was i dunno how young and never had an issue, when i got my licence i havent heard about it either. the law is everyone under 16 in the back wears one, over 16 its up to you- and everyone in the front wears one no matter what. thats all. the rest of it deals with child seats and regulations

In addition to the $90 fine that was already paid, I just found out that 3 points could be added to my wife's driving record for not having a seat belt on our 13 year old who was sitting in the back of the car. Do you think it is too late to do anything about the points? BTW, she has been driving for 20 years and never got a single point until now.

It certainly isn't my wife's fault because she always tells my son to put on the belt, but he sometimes gets rebellious and disobeys her. Even so, she didn't know that the belt was later unbuckled because she was busy driving. BTW, my son feels remorseful now (somewhat) because of the fines and points. Hope that he learns his lesson.

Any advice on the points?
