Why me? .... (Accident pics)

Cliff notes:

Got rear ended at a stop light, guy had no insurance, no license. I only have liability so insurance isn't paying for it. My dad says it doesn't make sence to sue cuz he doesn't have a job.
I went to 2 body shops and they are saying 2500+ and frame damage.






Frame damage no gap in between door.

OMFG

That sucks so bad. I loved your car. So the guy doesn't have any insurance, he should he be in jail or something for that. You can't pay for this yourself since it wasn't your fault.

He was sited for Following to close, insufficient insurance, misuse of a plate and operating an unregistered vehicle.

dude i feel for ya.

maybe you can get the parts from a junkyard, check www.car-part.com

i had hurricane damage on the roof from tiles. i had some jack*** hit and run parked in my own driveway and i had some girl hit me in a traffic circle. all within the last few months.

I'm sorry about the situation. You're just going to have to suck it up. Just get it fixed and get it over with. That's the best way to get through a situation IMO. Put it behind you as fast as possible.

Oh and once you're finished making payments for the repairs, get full insurance. Yeah it costs more but it'll pay for itself next time (cross fingers for no next time).

maybe it was karma for not giving a beautiful max a bath!

sorry, that was mean. i think you could still take the guy to court. even if he didn't end up paying for it, he shouldn't just get off free like that. good luck in how things work out. sorry to hear about it.

yep take that bastard to coourt and get a judgment against him.

BTW I don't know about there, but here a minimum requirement is uninsured/underinsured which will cover you if he is uninsured/underinsured.

That much damage on a 98 which has a reinforced rearend, I am supprised you did not get any neck or back injury.

anyways, that is good you are not hurt.

Dude, I TOTALLY feel ya. I was just t-boned in my 98 the begining of February. The guy sped through a yellow light in the rain and skidded as i passed through the intersection from a side street. because i had a stop sign (even though i waited much more than the 3 seconds), it got pinned on me. The frame was so bent that the sunroof did not line up with the rest of the car anymore. It is a terrible shame to lose a Maxima, I hope you are able to fix or replace it

Man, that breaks my heart just looking at it. Im a stern believer in full coverage myself, and my insurance is still crying because of my accidents. Oh well, thats what their job is, I just made sure to get my money's worth. I would still take him to court, I'm thinking that they will still make him pay for the damage, even if its over a period of time. By no means is it fair for you to have to dish that kind of cash out for someone's negligence, definetaly take him to court. Talk to him in person, find out if he is willing to pay for atleast half of the damage. Whatever you do, make sure you have his address, pay him a suprise visit with a few friends, just a friendly hello, that sort of thing....

I have been hit by two drunk drivers all you have to pay is the dedeuctable 100,500 whatever you have. You also have insurance for uninsured drivers and or hit and run on any basic insurance. Your insurance company is trying to see if YOU pay, they don't want to but they have to. Don't waste your time in court, it will cost you more in the long run, court cases can go on for years. Tell your buddy at the body shop to total your car out and he can have it for parts and or to sell after fixing. That max will never be the same again, get it totalled, use a hammer if you have to to bend frame, door sills, etc.

man that really grinds my gears.. the same thing happened to my dad christmas eve.... the car was parked outside and person(not disclosing nationality) hid my dads car backing out of the garage... then tried to flee... good thing i ran outside and threatened his life cuz he would have just left it like nothing happened... then what do i find out... .the guy has NO INSURANCE, NO LICENSE CUZ OF DUI, CAR NOT REGISTERED, AND HES **** DRUNK... barely can stand on his two own feet.. then he has the nerve to tell the cops that his wife was driving.... how do you like that one? we still haven recieved any money for the accident... just my 2 cents

i would make hime pay man... thats crap

I'll try to interject some logical reasoning here:

1) Did you call the police and have him ticketed/arrested for driving w/o insurance?
2) He might not have a job, but he might have some $. So small claims might be the way to go.

There's no reason you should feel any pity towards him at all. Our society was built based on laws and there's no way he should be getting around them by not having insurance or a job or a license. Sue his ***, give him what he deserves.

It makes me sad to see a beautiful Max look like that...

People sue and win for the stupidest crap in this country. I can't imagine you'd be left out in the cold if you take your case to court.

my moms a lawyer and she says you wouldnt have to have a good lawyer with all the things thus mentioned he was doing illegally. She said " take him to small claims court," you might not get money but if he does get any money you'll have amost of it he recieves if legitimate and otherwise he'll be sent to jail at least protecting you and others from the same deal.

I do have uninsured/underinsured insurance. But in the great state of CT that only covers you if you are injured not repairs to the car, you have to have collision.

What a sad situation Rick James.

I would find some way to make him pay. A couple of tickets and his car is proably fine to drive wouldnt cut it for me.

There is no way I would accept the outcome you've stated. Your left with your car damaged, and in need of repair?! Hell No.

Junkyard and F/S section will save you $$$. There are atleast 2 different maximas being parted out. And a I think kormax selling his trunk lid (black also). But first find out if the frame damage is repairable, if not then fixing the car wont even be worth it.

No sense in trying to sue, it will cost you more money now that you might never see or it will take years to see even a portion of what you spent. Have a friend at a body shop "total it out" only needs to be half of vechicle value if he looks harder he can find "additional" labor and parts I mean it is a 98 worth about 6 to 7 grand and you said 2500 damage, I would get it totalled.
