Whatever you do do not admit that you went through the stop sign. Let the police and insurance companies figure out everything. I bet this is goong to go against the person that hit you because you were hit in the rear quater panel. Given the area of the damage the other person should of had time to avoid you. Maybe they were speeding. My buddy worked for a body shop and he saw many car accidents like this that went for the person who pulled into traffic.
Damn dude that sucks..it know it looks cool but damn why would you have tints on the windshield? at least 35% or 50% but damn 20? Good luck with the insurance company.
btw is it illegal to have tint on your windshield there?

Why would he lie/omit facts and try to make it the other person's fault? If you make a mistake you should take responsibility for it.
It doesn't matter if he admits to running the stopsign or not - the stopsign was there and he ran it, the accident will be blamed on him unless he can prove the other person should share liability due to some other factor such as excessive speed (excessive = double the limit, and you have to prove that) or they made no attempt to stop after you pulled out.
Seriously, the OP should be honest about what happened. Sure, he can lie and delay assignment of fault - but how would any of you guys feel if someone wrecked into YOU and the lied to the police so YOU had to go back to the scene and take photos to avoid getting blamed?
It truly saddens me to hear people suggest he try to squirm out of responsibility... Are we not honest reasonable people here or what? I've been the victim in a few accidents where the other driver either lied or intentionally omitted key facts and sometimes I was able to prove his was lying, and sometimes I shared the blame for soemthing that wasn';t my fault (ie being rearended at at red light was reported as "He changed lanes in front of me and slammed his brakes on" and I had to pay part of my own damage.)

For the most part I would agree with you, except that if he turned out...THEN got hit, that other person probably should have been able to avoid him. I've been cut off and ended up hitting a delivery truck..the person that cut me off (that would have sideswiped me) just hauled ***. What goes around comes around, so if it's really his fault he should own up to it.....tint probably had no bearing on this accident though, unless he just had it put on, because you get used to it fairly quickly.

I've also been cut off by someone who fled the scene after I swerved and hit an unrelated car. It really does bite when you are a victim in a collision and the post-accident actions of the at-fault driver result in you losing your shirt. In that case I took all the blame because the unrelated car was 100% blameless and I had swerved out of my lane. Had the offending car stuck around I would have been in the clear, but they were not that honest.

Be honest with the police and the insurance and let them do their jobs as efficiently as possible. He wouldn't be the first person who thought he was at fault only to find out the other person was really to blame. That's why you never *admit fault at the scene*, but you do give a full and honest report of the accident to the police and the insurance and let them figure it out.
