Y-Pipe in CA

I'm a little confused when I look at the Cattman website there is a disclaimer that states:

"Aftermarket y-pipes for the 1995-2000 Maximas do not include the "pre-cats" (preliminary catalytic converters) present in the 95-99 stock y-pipes. As a result, this part is intended for racing purposes only and should not be used on public roads or highways. 1989-94 Maximas do not have pre-cats and are unaffected by Federal emissions compliance issues."

And then as I look further down the page, I read:

That YG4-SS is for "1995-1998 Maximas; all models, Federal and CA emissions." Can anybody clear this up for me? Has anyone had any smog problems or other problems with this mod in Cali?? Please let me know.

thanx

Joseph

It's a legal disclaimer

They make it for the cars... your responsibility to keep it legal...

The bottom line is . . .

If you remove smog equipment from a vehicle you use on the street, you're breaking the law. Now as long as you don't get caught, you've got no problem. But I live in CA and I've read the statutes. If you do get caught and cited, you'll have to remove the Y-pipe and pay a $5,000 fine!

I put up a post some time ago asking if anyone had ever been ticketed or fined for installing a Y-pipe. I never received a response. At this point, I can't tell if that's good news or bad news.

How's a cop to know the stock piece has pre-cats? I think when he sees the normal cat there he'll be a happy camper.

$5000 fine? Damn that might make me second guess getting one now. . . I would highly doubt that someone would turn me in on that, but you never know. . . So what can I do to my car to make it move quicker? I guess nothing if I continue to live in this state.

$5000 fine ..

Thats a lil misleading. I believe (not sure on exact number) that you can replace it after 50k/60k miles, or if its broken. (without a fine)

You still have to be able to pass smog checks also, all the time.

Hmmm. . . I know you can pass smog, as long as the engine is warm, you have to give it a good workout before taking it in. The only smog controls it effects are when the cars engine is cold, but the people who have followed the warm engine trick have had no trouble passing. . . Even in CA.

I am not quite sure what you mean by you can replace it after 50K/60K miles, or if it is broken. . . Do you mean that if you have that number of miles on your car, and you replace it with an aftermarket performance pipe "accidentlly" because you said your old one was broken, you can pretty much claim ignorance?

No sir, OgreDave. In CA, a Y-pipe will fail the visual inspection every single time. Now if you can find a smog check station that doesn't do the required visual inspection, you may be able to get away with it. But if they see the Y-pipe, you will not pass the smog check.

The fine in California for removing a catalytic converter is $1,500.00, not $5,000.00. Here's the applicable statute:

CALIFORNIA HEALTH and SAFETY CODE:
43008.6. (b) The state board may collect a civil penalty not to exceed one thousand five hundred dollars ($1,500) for each violation of Section 27156 of the Vehicle Code. Any penalties shall be paid to the Treasurer for deposit in the Air Pollution Control Fund.
(c) The civil penalty specified in subdivision (b) may be collected for one or more violations involving the tampering with or disabling of a gasoline-powered vehicle's air injection, exhaust gas recirculation, crankcase ventilation, fuel injection, carburetion, ignition timing, or evaporative control system, fuel filler neck restrictor, oxygen sensor or related electronic controls, or catalytic converter, or for the use of leaded fuel in a vehicle certified for the use of unleaded fuel only.

Is the Catalytic Converter removed though? I thought only the pre-cat was, or at least on my 95. Would the same staute apply?

Although I'm not an attorney, I'd suggest that the State of California takes a rather dim view of people removing emissions control equipment from their vehicles. If that's the case, I'd be willing to bet that a pre-cat is considered a "catalytic converter" as that term is used in this statute.
