3:45am - Just became a victim of vandalism which happened not even 30 min ago. As I was lying in my bed about to drift asleep, I hear a "thud" outside and a sec later my pager goes off. I burst outta the house and Im outside on the street probably 20 sec. later to look for an assailant -of course nothing. I walk around the car and see my driver side window obliterated by a 5 pound granite rock. I go back in and wake up my folks who come to check it out. My dad trys to investigate while my mom calls to make a report.
Heres the interesting thing: me and my dad are outside tryin to look for any clues or anything. I remember hearing a car with a loud exhaust like a block or two away when I first ran out of the house. So whilst my dad and I are outside, this modified black integ with EXHAUST, comes around the corner(we live in a corner house, in a small residential street), turns and drives off. I had reason to suspect the possibility of that being the one who did it. My dad and I are outside a couple more minutes and see a small compact car (looked like a toyota prius or maybe a kia) come around the corner, turn, drives by, and drives away. We thought nothing of it and had more suspicion on that Acura. My dad goes inside for a minute while I stay outside. Maybe like 1 or 2 minutes pass and I see what looked to me like the SAME small car comming back from the direction it left. I wasnt to sure though. The car turns into a street across the street while my dad comes back outside. I tell him about that car that looked like the same one. I noticed that car that just turned across a street busted a U-turn, started to drive back towards our direction, and DECIDES TO PARK IN FRONT OF OUR NEIGHBORS HOUSE ACROSS THE STREET AND TURNS OFF HIS HEADLIGHTS. Meanwhile, My dad and I was watching and he confirms that, that WAS the small car we both saw minuted before. The car sits there parked for like 1 sec and knowing our neighbor, for sure that person doesnt live there. My dad and I start to take a couple of steps toward the street and that car switches his headlights back on, and drive away. We both think "WTF....now THATS pretty peculiar" My dad ask if we should follow him and I agreed of course. We try to catch up in the direction the car turned and see one car's lights about a mile away. We catch a red light and see the car turn into a residential neighborhood. Patrolled that area for a couple minutes looking for that car but chances of finding it werea slim since the streets were small and complex. We Came back took some pictures, and finished the police report. If he is stupid enough to come back the same night and try to steal something, ill be ready.....and so will Mr. 12 Gauge...

Not for nothin...but you have the right, given to us in the 2nd Amendment to "Keep & Bear Arms". You have the right to protect your property and your family. You never know what type of scum could be out there stealing from you. You cannot come out of your house and blatantly start shooting at a thief! You can, however protect yourself if you feel your life is in danger. Deadly force can be used on a theif carrying a pipe or anything else that could be construed as a "deadly weapon". I am not condoning violence against someone breaking into your car. I am saying that you have the right to protect your family and property. And in the event that deadly force was used , you better have a good reason for using it. And someone coming after you on your property is a good reason. Not shooting someone in the back as they are pushing your car out of the driveway. 2 completely different extremes.

 

If he broke into your house carrying it, by all means kill him. But if he's standing outside, even if he's screaming "I'm going to come in and kill your family" you DO NOT have the right to go outside and shoot him.Period... family, NOT property. The law is pretty clear...a life is more important than property and you can not kill over property.

I'm not 100% on this (and nobody could be) but I believe in this situation if he went outside with a bat and hit the guy who broke his window, he'd probably go to jail for assault.

If you leave your house to "protect" your property then you're responsible for what happens. I highly suggest you learn some law before giving people the idea it's ok to shoot someone who broke a window in his car.

 

You should have just gotten his license plate number, with that you got name, address, everything.

I'm not going to get into a pissin' contest with you on this, I just stated that you have the right to protect you family and property. In the event you feel your life or your familes life is in danger then you sure as hell have the right to shoot him on the spot! That is the law! It is called "self-defense" I am not a expert and don't claim to be, but i do know my rights. If someone is on your property with a weapon screaming they are going to kill you and your family and you shoot him, there isn't a DA in the country that will prosecute!

Someone on your lawn is not an immediate threat...if he goes for your door, he's fair game, but just standing and shouting while you're locked in your house means nothing. Again, I'm not 100% on this because it's different in every state, but if I walked on your lawn at midnight and started yelling "I'm going to kill you!" and you called the cops, I don't believe they'd arrest me, and if they did the most I could be convicted of is tresspassing.

Ok after having both of my max's either being stolen and broken into i say if you see them donmt shoot them but beat the ever living $hit out of them. Personally i dont think police do a damn thing. uhh thanks for the info about the "firearm" topic. Dont worry guys, I kinda said that in a fit of rage last night, and also wanted a creative title. I know the consequenses of shooting a human being is highly punishable and morally wrong (in the sense of doing all you can to protect life. LIFE<PROPERTY). If it came down to it, I most likely wouldnt pull the trigger unless I feel my LIFE or the LIVES of my love ones were in danger. And even then, I wouldn't shoot to kill. Anyways, guys, no need to get into any arguements.

As for the other questions, no obviously we didnt get any plate #s. 1 of the main reasons I'm ticked off. Also the police cant really doing nothing about it. What's done is done. They are not going to spend time or money to have someone investigate. I'm sure cases like these all too frequently. This morning one of my friendly neighbors across the street came by and came to talk for a bit. He said he was in his living room when it happened and looked out when my alarm went off. He remembered seeing a dark colored car. I asked him if it had a loud exhaust and he said it did.

Almost all the anger is out of my system. I know its just a window...easily replacable, insurance should cover it. Of course its just the principle of the thing. 1. I am not in my house locked behind the door shooting out my window
I am on my front lawn confronting the tresspasser who is breaking into my car.

2. I do not shoot this person in the back as he is climbing in the window of the car or pushing the car out of the driveway.

I let him know i am there and to either stay were he is/ while someone calls the police, [or get the fu#k off my property and don't come back, if i'm feeling gracious]

3. This person turns to me with crow bar, gun , pipe any weapon and says "I will kill you and your whole family" and starts coming towards me.

BANG! All over no questions. Did i initiate this? No ! He iniated it by coming on my property and tried to steal my belongings. Did i feel my life was in danger? Absolutely! Would it be justified? Absolutely.

Hope this clears up my stance on this matter. Too many rights for the criminal and not enough rights for the hard working people in this country!

What did that say? "If you go outside to confront the burglar you can NOT then use self-defense as a defense" and "If you can avoid using force by giving up the object or retreating, you must."

You were safe inside, by going outside you gave up your "self-defense" defense and escalated the situation. Go outside to defend your kid, stay inside and call the cops if someone throws a rock at your car.Stop right there... according to the law you're already guilty. See law in bold above.The law is not confusing...if someone's in your house, shoot. If someone is outside your house, get your gun and wait. What's confusing?
