Augh! Accident

Augh! Accident

I was driving home in the left lane of a four lane (combined) street. The guy who caused the accident was turning left against me without a green arrow. I had a green light and was cruising at the speed limit (30mph) when he started his turn way too late. I slammed my brakes, applied the horn and tried to steer away but without ABS, was screwed. I clipped his rear panel hard enough to bend his axle. My front bumper will have to be replaced as will my grill. My passenger side bumper lights are FUBARed and my passenger side clearance light is gone. This sucks.

That does suck, was he found at fault by the 5-0 report? Best of luck.

Cop said he didn't assign fault but he did give the other driver a citation for FTY upon left turn.

what the hell? this is going to be hard to win since no one has proff of anything. his story can be that he made a safe left turn on his arrow. unless if you have witnesses, this will be hard, but best of luck man.

That's weak what the cop did. You really should have protested that on the spot, talked to anyone who saw the accident, etc. However, since he did get a ticket for failure to yeild you have some points in your favor with regard to having his insurance pay for the damages.

Good luck getting it fixed.

when he was issued the ticket that puts him at fault. Know the ins company has to prove that he was more than 51% at fault.

Unfortunately, in some states, an officer can issue a ticket at the scene of an accident without stating who is at fault. By doing what he did, he technically called it a 'no fault' accident which is going to force THT into proving the other driver's fault in court.

Like I said, the ticket does speak volumes as to who was at fault, but he'll still have to prove it.

Well, the other driver admitted fault on the scene in front of the cop so if it goes to court, I can fight it.

you probably won't have to go to court.your ins company will handle most everything for you thats why we pay ins.

AHahahHAHahHAhahahhaah ... sorry man, I just find that seriously amusing. Insurance companies are by far, the largest legal scammers in the free world.

Think about this....

Minor accidents where no one was hurt hardly ever going to court.Sure there are cases where someone doesn't want there rates to go up so they lie but how often do you think that happens?

The big cases where someone totaled a 30,000 dollar car and killed 2 people that go to court.
I really don't think ins is a scam. If you think that maybe you should decide not to have ins on your car and save yourself some money and see how much you were getting scammed.Hopefully you don't get pulled over or get into an accident. Sure you may be paying for something you may never use but in case you do use it is well useful.
(My girlfriend hit a deer and has only paid maybe 600$ to her current ins company.She got estimates from 3000 to 5000$ to have it fixed and got a check for 5000$ from her ins company. How are they scamming looks like they just lost some money on that claim).

I'm hoping the Midwest values come through (his insurance is a small carrier based in Iowa) and they don't bend me over a table. I'd rather not have to take this to court and doubt it'll go that far. I do plan on doing the 97 conversion though.
