Ebay

They always available at ebay for between $15-30 each. programming is easy. Just takes like 10 seconds.

Is there any way to check my old one, besides going to the dealer?

Obvious suspect would be the battery on the fob. If not try reprogramming the controller unit.

To find out if it's the fob or the controller unit thats faulty, I would try and get hold of another maxima and see if your fob works on that (just make sure you reprogramme that to the original fob afterwards )

If you replace the battery, do you have to reprogram the remote?

Someone should post the link to reprogramming instructions so the guy can try that first......

If that doesn't work, I have nice one with the Infiniti logo for $20 shipped!!
