Lemon Law

Can someone tell me more about lemon law in CA, I heard someone told me that if my Maxima is a brand new car and it fail me 3 times (won't start) within the 1st month, I am eligible to ask for another new car.

How do I go about doing this ? Who should I talk to first ?
Where to apply for this and where to find the detail info ?

That's how the law is applied in MA (3 occurrences of the SAME problem, and fixing it each time did not get rid of the problem). I think you should contact the dealership that you got the car from, and see what they say. If they give you problems, contact Nissan Consumer Affairs (or whatever that dept. is called) and let them know all the pertinent info. NH, for example, sets up arbitration within 48 hrs between Nissan reps, dealership reps, and you, and then it gets settled like that.

Make sure that this is the SAME problem that keeps arising 3 times, because I think that's the only way that the Lemon Law can be applied. Also, your Owner's Manual may have CA Lemon Law info in there (probably somewhere towards the back, where the warranty info is listed as well).

P.S. You can always contact the Better Business Bureau, and they would definitely know the procedures. Let us know how it goes.

Done the lemon law a few times. You HAVE to have excellent paperwork. Make sure everytime the car goes in, the ticket reads exactly whats wrong and what was done to fix it. Do NOT leave w/o a ticket. Even if they say "eh...no charge" get a ticket. Make notes of all conversations (times, individuals, conversation content).

There are steps to arbitration (sp?) and follow them exactly. Each car company is different. My family and I have won both times against GM (86 Buick with horrible paint) and a 95 Dodge Caravan with a vibration that related to the tranny/TqConv. Both settled out of court to keep the vehicle from being deamed a lemon.

Didn't you post in another thread that it was the alarm? I would think they can fix it. Have you talked to the dealership 3 times about it or has the problem just happened three times?

If the problem has just occurred 3 times, there's no way in hell the lemon law applies. But if the dealership has actually attempted to fix the problem 3 times, then you are in luck.

Sometimes I read these threads and wonder in the wisdom of others.

Just because it happens three times in your presence doesn't make it a lemon. In fact, if it has happened three times, and you haven't taken it to a shop yet, you should consider who is more at fault, because I know anybody’s defense attorney will consider this. It usually takes three visits to repair the same WARRANTY covered problem to even consider the word lemon.

Sometimes it doesn't hurt to read your owners manual either, which you apparently have not done, or have completely forgot. It clearly states that any time a problem exists with a covered component; it is YOUR responsibility to ensure that repair is completed as soon as possible to minimize any further damage. Failure to comply with this rule will exclude your warranty repair of this item. ...according to the fine print.
