got a speeding ticket the other day...
hey guys.. i got a speeding ticket the other day.... got clocked at going 38 on a 25. it was such a speed trap... i was going up hill and wasn't paying attention to the speed limit... the cop was hiding behild a tree or something... I'm going to go to court to contest this ticket... any advice on what to say?? sould I admit that I sped? need some advice. thanks
Don't know what's going on. Anyway I got caght running a red light with one of those cameras here in Queens NYC. I swear, those things are great...getting caught running a red light and not having to be stop by cops is great.

If you want to take risk, when you see the prosecutor don't accept the deal... meaning you contest the charge. Prosecutor will then give you a different court date and at that time if the cop who gave you the ticket doesn't show up, the case will be tossed by the judge and your charge will be dropped. No points, no fine... but I think if the Judge feels you deserve the ticket then the dude has the right to find you "guilty" and still charge you with the ticket.

In my county this year they've written 3X as many traffic citations as they did last year so far... When the budgets get cut, they gotta get that money back somehow! Writing tickets = easy money

Haha wow...i had the EXACT same scenario happen to me a month and a half ago. Except i was doin 41 in a 25(late for an appointment with my registration guy at college). I got out of it with a 2 year old PBA card cuz it was from NYC that my friend gave me and it just so happens that somehow this cop worked in the city with him. This card has gotten me out of 2 tickets with 2 different cops in my town that worked with the guy i know in the city...i guess i'm just really lucky. I didnt check ur profile...maybe we are from the same town??? cuz thats the identical thing that happend to me
I don't know how things work in Ohio, but here in Jersey a speeding ticket like that would get lowered from a 38 on a 25 to "unsafe operation of vehicle", which is just a ticket, no points.
I know this because I went to court once for the same reason and I didn't even need a lawyer.
After 40 mph it would be tougher since you would have been exceeding the speed limit by over 14 mph.
Check the ticket, there should be a section where they check how much you were going over and yours should have a box checked next to 1-14 mph over the speed limit, which shouldn't be too tough to be lowered to a no points charge.

Plead no contest and ask for whatever non-recorded punishment the court has (like here in IL, they have 'supervision' and 'driving school')... the court gets their money, and you walk away with your record clean, sans a little money and time.

I got 1 goin 41 in a 25 a long time ago. What are you complaining about I got one a few weeks ago for goin 77 in a 40. If have not gone to defensive driving school in the past two yrs do that and it wont go on your record nor will your insurance go up. I just go back from the 8hr class this morning and its the most boring **** ive done in a long time. There were some hot women in there
but back to the subject. If the class is not a option pleed not guilty at the pre-trail confrence. The judge will then issue you a trial date. When you get to the trail look around if the cop that pulled you over is not there stick around and you have no evidence against you and you'll be let go. If he is there, tell the judge you have decided to speak to a lawyer and he will give you another trial date (30days) when you go again look around for the cop who pulled you over if he is not there, like I said stick around and your free! If he is there, make another excuse and get another trail date. Repeat this process until the cop does not show up, sooner or later he will stop giving a damn and not show. Btw my lawyer told be to do this

Just go to your local City Hall and request a copy of the Speed Survey which should be updated every five years. If not undated, it's already invalid. Cops should not be writing tickets for that stretch of road. Furthurmore, ask what the 85th percentile is. My guess is somewhere around 33. But you never know, it could be 38 or more in which case the police officer cannot write you a ticket. Peace...
