Problems w/ Insurance and body shop after accident

Hello All,
The body shop finished most of my car but they gave it back so I could
go to Florida for vacation. They didn't fix my sunroof and I noticed that they
left tons of little scratches on both drivers and passenger side doors. Also I have in cabin rattles and the pulley and or belts are squeling out of control.
The sunroof was knocked off track by the hood coming up and smashing the roof and windshield.
Today the insurance company adjuster came out to look at my car. He said
he doesn't see how the sunroof got knocked off track by the hood hitting the roof. He said he needs to be certain that the hood did the damage and it wasn't like that before the accident.
So I went to the local Nissan dealership and talked with a known service rep.
I told him all the problems I had with the car after the accident such as squeeling, alignment off balance, and rattles. I even explained to situation with the sunroof and how the adjuster thinks the accident didn't cause it to fall off track meaning they will not pay to fix it. What a bunch of Shiznit.
The body shop needs to fix all the scratches they left. I looks horrible.
Besides all the negative results, the 2K3 bumper and grille with AE headlights looks pretty sweet. Will get photos soon.

how much has the accident cost you so far? from the damage you have described so far, i'm kinda surprised they didnt total it

I believe it was around $4000.

I had the same problem..The only thing you can really do is fight and stick with it. It is the insurance companies job to try not to pay for everything. When i got into an accident with my 03 Max it bent the steering wheel from the force. The adjuster tried to tell me it was done by me at a previous time and was not related to the accident. He tried to do the same thing with my windshield saying that all the chips on the glass were not related to the accident, but any person could see that it was. Then he even tried to tell me that the radar detector that broke and fell off under the car, a Bel 615stiR(built in radar), wasn't covered because it was illegal in New Jersey. I got really ****ed and pretty said "fine you want to play this game." I called a friend of mine who was a state trooper, who happen to still be on duty, to come over. He told him that radar detectors are not illegal in NJ and all of a sudden he said, " Ohh I might thinking it's NY that they are illegal". S*** B**!! The only thing you can do is fight with both the insurance company and body shop to fix the car the way you want it. GOOD LUCK!!!

Your insurance company will usually back you up for any shoddy repairs, assuming you went to a shop on thier "approved" list (scratches, poor paint, items on the estimate but not completed, etc).

As for your sunroof, you'll want the shop to help you out. They want to do the repairs so they get the money. Chances are, either the impact g-force messed up the sunroof, or the frame of the car shifted somewhat and messed up the alignment. Not at all unreasonable and your insurance should see that with the shop helping to point ou the correlation. Typically, if they can see a possibility of the accident causing the damange, they cover it so that you don't complain to the Insuracne commissioner/board in your area. .

Most insurance guys are body men, not mechanics. They are pretty easily convinced that they should cover the loss if any kind of mechanic says "yeah, the belts are loose due to the front end impact". See if your body shp has a mechanic that they work with regularly. They can get a consult.

The insurance guy called me today. He basically said that he will not pay to fix my sunroof b/c some repairman stated he was %90 sure the accident did cause
the sunroof to fall off track in the rear left section. (The sunroof will still operate correctly, the only problem is that went it shuts, it does pop up to lock
a seal on the left rear corner.) There's enough explaination that the accident cause this to happen. The damn sunroof wind deflector smashed into pieces and the roof had dents in the front the impact of the hood. He also said that if the accident did cause the sunroof to break then there should be some damage to the sunroof glass. But in this cause there isn't. WTF?

What should I do?

Try BBB. They should be able to help you. Otherwise, lower your deductible, wait a while then make another claim to fix the dented roof as well. If you are a good DIY, e-mail me and I'll forward you the portion of the FSM that shows you how to adjust the moonroof.

The body shop fixed the dents on the roof and ordered a new
wind deflector. I will try BBB.

You can also keep fighting it. If they say it's 90% sure it didn't happen with the accidnt, then the converse is a 10% chance it DID happen. They cannot say it didnt' happen, they can only say it probably didn't happen. They just shot themselves in the foot. One complaint letter from you to the district manager, quoting the guy who said only 90% chance, and they'll cover it for you.
