Lemon Law
I am not familiar with CA, but here in MD it goes as such: If you take your car in for a problem three times and the problem is not resolved, you can in some cases force the dealer to buy back the car. It is not an easy thing to do, but my dad has done it before with a car that had a faulty ECU. It turned out that there was a bug in the ECU programming that they could not fix. The dealer bought back the car and we got a new one that was a later build that had no such problem.
One of the books in the little black tri-fold that your manual is in is about the lemon laws for each state. There should be a synopsis of the CA laws and your rights under the law in there...(It was in my 2k maxima owner's manual packet, maybe not for others)
try www.bbb.com they handle dispute resolution. When I registered a complaint with them concerning my pursuing the lemon law, it lit a fire under Nissan's A$$ and they got cracking fixing my car.

-tried and failed the repair 3 times
-car is less than 18 months old
-they have had your car in the shop for more than 30 days.

I guess the 3rd time is a charm... cuz they seem to have gotten it right this time...
To date, my warranty repairs:
1) replaced catalytic converter
2) replaced clutch
3) fuel sending unit (twice)
4) ECU updated (twice)
I'm thinking maybe I should get the extended warranty
