Fuel cut saga - anyone else?

Short version: Y2K GXE 5 spd with fuel cut problem, 35K miles but never taken to the dealer with the complaint (I knew there was then no solution). March 21 2001 TSB calls for new part numbers on the ECM codes (review the TSB). EMPIRE LAKEWOOD NISSAN in Lakewood, Colorado just called me to say there is no warranty coverage for the reprogram ("no parts are being replaced")after the 12 mo/ 12,500 mile "adjustment period" expires. So while Nissan dragged their feet with this, everyone who has experienced it blows thru the 12/12.5 limitation and, voila...new service revenues!, if you want it done, son. The service manager said, "I guarantee you that I will never reprogram your computer on warranty." I have insisted that they replace the defective ECM on warranty. He actually insisted the ECM is not a component of the drivetrain and not covered under the 60/50 drivetrain warranty. Anyone else dealt with this line of reasoning? Any suggestions?

Saga continues

In a conversation with Dave Williams, General Manager of Empire Lakewood Nissan, Lakewood Colorado, he reiterated that the reprogram of my ECM after the 12/12.5 adjustment period has expired will be at my charge. I suggested that he was probably aware of the effect of his arbitrary decision on any long term relationship with his dealership would be. I have years of car buying left in me; my wife and two kids do as well. And referrals? Forget it. It's amazing what a dealer will pay to acquire a new customer; and amazing for how little he'll blow off an existing one.

I'm pretty much in the same situation as you. You probably already know the answer...find another dealer that will do the reprogram for free. You have a copy of the TSB, right? Why would Nissan bother to make it effective for early manufactured 2000's if they know most will be beyond the adjustment period. Doesn't make sense to me.

Thanks for the info! I'm at 10,500. I'll get this done immediately. I thought it would be covered for up to 36,000.
