Uninsured dude just wrecked my '02
Just go walloped front right corner and spun then hit back right corner on my prized 6-speed '02. My guess is it's totaled b/c the front (bumper, hood, headlight, fender) are all involved, as is the back right corner (bumper, quarter panel, door). Anyone had a similar accident, and was it totaled? Oh, my radiator drained as weel, but the wheels looked fine and still rolled. I was able to drive it 15' to get it off the road, but I shut it down immediately after that since the radiator was drained.

Man am I happy I hadn't gotten those DDe's I've been thinking about. Am I allowed to remove all the non-stock stuff (Clear corners, STS, Leather shift boot, FSTB, RSB, etc...) from it if they total it? I may be having a sale if I don't replace it w/ another Max - it was hell finding what I wanted the 1st time.
if they do not insure it, and most do not insure non-factory parts you can remove all that stuff. better yet, pay someone at the junk yard a little $$ to take the stuff out for you, or let you take it while he turns his back... then sue him for it because it was not covered. or say it was damaged... either way you can get your money back... and even make some off of the a** hole who drives uninsured!! even if he has no money a court will garnish his wages to have to pay you back.

Well your car is totaled if the repair is 80% of book value. IMHO I dont think you are totalled. You didnt mention any frame damage. Did your air bags deploy? My guess is you probably have about $5,000 in repair.
As far as the uninsured driver, you have SUM/UM. Which is uninsured motorist coverage. I hope you got as much of this as you could. Ususally the minimum is $25/50K. You'll be covered. This is a cheap insurance upgrade, i paid $29 for an extra 50K coverage for the year.
If he was uninsured, he probably has no money for you to sue. So if you're not hurt, just let him go. The law will take car of him, he's going to jail.

as i said before, even if he has no money, the court will garnish his wages, i say dont let him go... nail him to the wall and make him regret it. thats the only way to stop people from doing it.
I had a similar accident, except it was the left side and only the fender, bumper, grill and hood were involved. It was approximately $1500-2000 to fix. I would think, based on that, that you won't even be close to totalled.
As far as sueing this guy, I'm not sure it's really worth your time. What kind of deductible do you have? It may end up costing you more to sue and you probably won't even win. Unless you have at least a witness (not someone riding in your car), preferrably multiple on your side, it would be very difficult to prove anything. It becomes a he said, he said situation. When I was hit, it was pretty obviously the other person's fault, but there happened to be a witness that sided with the other person. There wasn't even any damage to the other vehicle (stupid Jeep grand cherokee). Her insurance refused to pay, and my insurance even payed for her damages (there was maybe a scratch on her bumper) and said it was my fault, all because of the witness. Besides, your insurance already knows that you had the accident. Whether it's your fault or not, they will use this against you when renewing your policy. I wouldn't bother.

Something just occured to me. If it does end up getting repaired then I'll have a front bumper and hood w/o a bunch of rock chips!
Who knows, they might even use better paint that the factory. I guess I need to go order that ClearBra and put it on before any new paint gets chipped. Now that I think of it, that side's fog light was cracked too. Maybe headlight and foglight covers too....

Better paint is definitely a plus, no rock chips on mine. Depending on how good you know the bodyshop, you might even get a few freebies.

I paid $16,500 a year ago (I knew then I got a good price) and KBB and NADA both list it between $16,650 and $16,950, so in theory I'd make $$ on it, but I'd be left with a many hundreds in mod parts I couldn't use (if I didn't replace w/ a Max) or I'd be on the market for another clean (This one was spotless even 2 yrs old) 6 speed '02-'03. And I couldn't replace it w/ an auto, especially w/ my Maxima.com username.

CARFAX will not necessarily show the damage. The accident I posted about earlier, does not show up on CARFAX. I'm not going to lie when someone asks me about it, but don't always expect to get every little accident from CARFAX. It's probably because there was no significant damage. Not really sure exactly.
I just got the quote - just under $8K. The repair place showed me where the guy hit me initially, right in the right headlight, how if his bumper had been 3" lower, he'd have gotten the front frame rail. As it was he just missed it, and in doing so, kept me from having anything serious twisted. It's prettymuch all exterior panels and such with the height/places he hit me. The real fun is that it's going to be almost 5 weeks in the shop, and since the jerk who hit me has no insurance, I get no rental car as I wasn't carrying that rider on my policy.
To top it all off, a guy I met the other day through a friend asked about the accident (he'd heard) and then had the b@lls to tell me that he thinks mandatory insurance is unconstitutional, and that I shouldn't be complaining since I have my own insurance. It was everything I could do not to clock him. He didn't see me being out a deductible or a set of wheels as an issue "the cost of doing business".

go to the doctor immediatley and complain of neck pain, your car insurance will cover the bills, get referred to a specialist and start getting free back rubs and weight lifting recovery, at the same time go get a lawyer and tell them your case so they can get the paper work together, once the therapy is over you can go to court and sue him for bodily damages
in a couple years you'll end up with a few extra Gs in ur pocket, gl you deserve it for the time he is making u waste
go sue man.. cuz someone !@# did a hit and run on my passenger rear door.. But as far as that kind of body damage to the car, I don't think it will be totaled since the air bags did not deploy. But then again, I guess it could be different depending upon the insurance company and state laws. So if you're car does get totaled then yes you should be able to get your after market items back, or atleast the ones that you can take off, b/c that's what happened to my friends 02 max. The air bags deployed and his car was considered totaled. He couldn't take any of his items off, except for the front strut bar. Everything else got cracked or seriously damaged in the wreck.

i was saying to sue him for the depreciation because the car has now been hit... it is worth $thousands less now and insurance does not cover depreciation. taking him to court for $200,000 in medical cost and "pain and suffering" is insane.
and another frivilous lawsuit is a big deal, it clogs the system for people that have legit law suits.

I didn't take the time to read this thread but from the initial post and about getting coverage for performance enhancing parts, I have this to write. When my TL got totalled they raised the amount of money I got because I had replaced the brakes no later than 2000 miles from the time of the accident and also for the Comptech sways I had installed.

BS!! maybe you dont know, but his insurance will go after him as well for the cost!! my brother in law represents insurance companies.... and yes some medical treatments easily reach $200,000 after you goto 100 different doctors, and are thrown into 200 different machines, trust me my parents own a Medical Billing Company, a SLOW doctor bills $800,000 - $1 Million a year.
do you think any lawyer will take a case worth 6-8 g's??
none that i now of, my brother was punched in the face at a Saliva show by some guy wearing brass knuckles, all he did was break his nose and fracture the orbital socket around his eye (did not even require surgery) and his lawyer will not settle for less than my brother TAKING HOME $50,000!
and you talked about faking an injury, not going to the doctor and making sure you are ok....

People agree to laws until they are the ones breaking them or getting prosecuted by them.

But you make some good points. When my car got totalled by the drunk driver who had no insurance and was driving his Mommie's car, I know she was the one who would get screwed. Luckily, he was prosecuted and convicted for DUI, but it also probably left her with some problems.
