Bald Tires Void Warrantee!?!

OK, this sounds like a crock of **** but.... my friends car has 40,000 miles on it and its and 03 and he has never rotated the tires and he has aftermarket rims and tires. Yesterday his 1st gear of his transmission went, he brings it into the stealership to have it fixed under warrantee, they say that they have to do some investigation because his front tires are bald, which is a sign of abuse, and this might be a basis on not warranteeing the transmission. how can they base a broken transmission on the quality of aftermarket tires that they dont even know were new to begin with?!?

They could say he is doing burnouts.... the rears are fine and the fronts are bald and a blown tranny usually points to some **** doing burnouts.

sory guys, the fronts are bald on the edges, signs of under inflation, and have about 35% tread in the inside

How are the back tires? I would say they are just trying not to pay for a tranny

the burden of proof that it was abuse is on them. you could swap the front/back tires, and go to a different dealer. if all else fails, you could contact nissan of north america hq and talk to them. after that it's going to the attourney general or some soft of lawyer. in the end, it's the dealer that has to prove YOU wrong, not the other way around.

That's bull crap. I've mounted used tires on my rims before. Basing their decision on bald tires is bull

1. do a tire pressure reading...if it's below 32psi (cold) show them that...underinflation.
2. suggest to them that (duh) the tires are bald because you need an alignment
3. let them know that you bought the wheels/tires used and they were like that....

then bust out the moss-magnussen act and tell them to PROVE that your tranny issues were caused by the tires. Since there's no way to prove it, they are required to do warranty work

oh, and make sure to call nissan N.America.

We have seen many off brand extended warranty company adjusters inspect for any evidence of abuse, or any way out of paying a legit claim. Usually our factory warranty would not question it(Saturn Saab dealer).
Is this an extended warranty.
Best bet is to put OE wheels back on and go to another dealer.

He said that the car is a 03 and has 40,000 miles. Therefore, it's covered under the factory powertrain warranty.

I would say save the hassle of dealing with that stealership and go to another. Be sure to rotate the tires or have the front ones replaced first.

so even if they deny the claim and say he has to pay for the tranny, if he goes to another dealership with the stock rims and tires on, they wount find in the computer that he was denyed somewhere else?

From everything I've read/seen, no. It's the dealer that prolly denied it and not nissan. If the 2nd dealer is owned by different people, they won't share computer systems. When I bought my Max, I asked the dealer to lookup any work done on the car and they could only see what was done at that dealer and not elsewhere.

service communication, every dealer runs your car on a service comm, which is through nissan. they can see recent warranty work, etc. open recalls...

ford uses OASIS, Porsche uses an e-DCS, GM uses a VIS. all, if not most have them...

If the dealership never submitted a claim to nissan, then it wouldn't show up. My bet is that they saw the bald tires and gave him the bird. A lot of the service departments are lazy and wouldn't document what happened.

could mean the difference between a bit of misinformation...

if its a WRX, for example, hes fuc*ed, same would go for most AWD cars.

^^^I would say it wouldn't matter what kind of car it is unless it's a Ford, in which case you would be fuct because their powertrain warranty is only 36k. Almost every car manufacturer has a powertrain warranty of 60k or more now.

chevy doesnt, Porsche doesnt, i could find more, but it doenst matter... warranty can be voided and repairs can be declined to to abuse, misuse, lack of maintenance, etc.

i PROMISE that something with mismatched wheels, tires, tread depths, etc on an AWD car, like an evo, the tranny wont be touched under warranty...
