First off, sorry to hear about the accident dude, it sucks and I've been in a few myself as a youngster. Hope you and yours are all doing OK.

I have some info that may or may not help you but I figured I'd post it. I've only had the misfortune of dealing with one totaled Nissan, it was an I30 with a blown tranny that was slipping badly. Accident on it was very similar, it was hit from behind while making a right turn of all things and then the hit made me spin out and hit rear side panel also. The insurance first was gonna pay to fix it, but then when they opened it up the frame was done so they totaled it and I just took the money and got a new-used car.

That car had very similar, probably almost same amount of damage money wise. It was a 2001 I30 with around 180k miles, they never knew about the tranny issue and I got 5k from them. So maybe that can give you some idea on what to expect.

Hopefully I've been of any help, and good luck with everything!

Ty for the advice the thing is from all the negative feedback I have read about Infinity Insurance I am just going to get a lawyer. It is just not fair how they treat people.

its all insurance companies man they all suck none of them are different theyre all under the same umbrella just different names. they totaled my i35 and it was clearly worth 7000 and they wouldnt budge the extra 800 and they only gave me 6200 almost took them to court since they had accepted full liability seeing the accident was their clients fault but lawsuits take too long. good luck with everything

If you had a decent lawyer, they would foot the bill for a rental and have the insurance company or you pay them back depending on outcome.

I totaled my Max out a couple years ago and got a lawyer that same morning. The lawyer doesn't really get involved with getting your car appraised or anything like that. They will attempt to recover losses from the simple soft tissue injury you had. I ended up with minor injuries and the other person's insurance ponied up close to $20K. $7k of that went to medical bills, and the rest was split between me and the bloodsucking lawyer.

It doesn't look like she was going that fast. In our state, they could cite you for being too close to the person stopped in front of you. With the minimal amount of visable damage, you must have been real close to the person in front.

Sounds like the lawyer did a good job for you. Ins. co certainly wouldn't have payed without one.

You need to go talk to your attorney.

First, you need someone to evaluate whether she has coverage. Just because they say she doesn't, doesn't make it true.

Second, as for the car, your ins. co should pay - minus the deductible - now that the other side has declined coverage. In FL, they would have already paid you because it is a no fault state.

Third, as for the personal injury, your ins. co. typically gets to have an "independent medical examination." It is anything but independent. Normally a third party "outsider" business that hires Drs. Don't do it without talking to your lawyer first.

Short of it - go see your attorney.

Pm me with the name of your attorney. I may have someone for you to talk to.

Full coverage on your car? There'd be no reason to fix that.
