overdrive problem

I have 2002 maxima the transmission does not shift into overdrive under 45mph I flushed the fluid about 2 weeks ago didn't feel a difference has 165000 miles it feels like it it boughs down and lacks power when I first take off it stutters when driving about 40 the Rpms go up about 1000 before I feel it accelorate never delt with a problem like this with any other car I've driven. Any ideas or suggestions about what could be going on would be great.

Proper amount of fluid in? Are you positive it's not going in at that speed? The temp sensor for the tranny needs t read a certain temp (I forget what it is) but if it's not at that temperature, it wont shift into OD. You can definitely feel it when the lock-up torque convertor kicks in.

Not sure if I'd want OD at that particular speed anyhow.

When on the highway say at 60 MPH, leave it in 3rd, and then shift to 4th and see if you get that slight RPM drop and slight shutter when the lock-up kicks in.

Yes I have left it in third and shifted to fourth it is fine when going 60mph it's when going under 45 it doesn't and when I let off the gas going below 45 the rpms drop down to 1000 like it doesn't stay in gear then when I give it gas the rpms go back up to around 2000 before I feel it accelorate the fluid level is good. How would I go about checking the temperature.

Conditions for Lock-up Operation
NFAT0015S0301
When vehicle is driven in 3rd or 4th gear position, vehicle speed
and throttle opening are detected. If the detected values fall within
the lock-up zone memorized in the TCM, lock-up is performed.
Selector lever D position 3rd position
Gear position D4 D3
Vehicle speed sensor More than set value
Accelerator pedal position sensor
(Throttle position sensor)
Less than set opening
Closed throttle position switch OFF
A/T fluid temperature sensor More than 40°C (104°F)
I also read somewhere about the lower limit being 50 MPH.

Or you can try this weird sh^t. I've done it but it's really strange.
