So some looser snow plow driver or someone else thats possibly semi or full retarded thought it would be appropriate to leave a parking curb in the middle of a lane way.

And to add insult to injury the first thing the property manager said to me is: "Do you have a lawyer?"

Tried to Contact Tamy Brown at PenEquity, the property manager.

2009/04/03 9pm impact, car limps home, into garage to wait for monday
2009/04/06 emails and voice mail sent, spoke to Tamy Brown, "do you have a lawyer?" is her first response, quote included.
2009/04/07 emails and voice mail ignored.
2009/04/08 still ignored, emailed the pres and vp of the company at this point., 3 minutes later I was called back..... :-O yes shocked

i would get them for everything , tell them the Y pipe is bent / leaking..

make them pay for a set of headers, tell them you hit it so hard that the header is bent up top or something...

i would have told him, it would be in both parties best interest that this is settled out of court. Then I would have asked him, HOW'S YOUR FAMILY DOING?

Dude, I hit it at night. I came back the next day to take pics. And it was still there. They have since put two orange pylons around it. Grrrrrrrrrr!!

I wish you did too my friend. Cause this is a total joke. No doubt thease guys neglect to maintain their property. I cannot see how this could be my fault. It blends in so well with the pavement it's not even funny how stealth that curb looks at night. It just sucks to have my car off the road again. I was all excited to be driving her again after her winter slumber.

Not advised! Kam is smarter than that and will do it the correct way. Wouldn't risk his job or a harassment charge for the property management's ignorance. They'll settle out of court once they realize that they are liable civilly and additional cost; attorney fee's, court cost, loss of job wages for days taken due to incident etc... Good luck and I have faith, it will work out in your favor.

I was mentioning what I would do....

I am sure anyone on these forums would prefer getting a lawyer and waiting out the legal proceedures.

Out of court settlement usually settles for less the asking amount of the victim. And more than likely, Kam will have to fork over a big chunk of lawyer fees before appearing in court. (thats if Kam doesnt find a lawyer who is willing to wait for payment).

That's not mentioning the wait time for the payment check to Kam.... I feel really bad for him and his car. Especially the time he has to wait in order to get things fixed. Good Luck Tony S...... errr i mean Kam!!!

Same thing happen to my father, but it just messed up his bumper, the owner basically said, how much is the damage and after that gave my Father a check and said sorry, we will fix the parking block

If your forced to sue, sue for 3-4 times what the damage is, time and agony and blah blah blah and lawyer fees

Didn't even have the chance to hit the brakes. It may have caused more damage if I did, as the car would have nose dived. I'm running my Koni/AGX setup on soft right now, so it would have def nose dived into the curb even more.

..A senior citizen hit and run... That's some Sh** to get on tape man.. DAMN!!

Kamski, sorry to hear about the mishap bro. At least there were no injuries. Get your mechanic to check everything out that could possibly be damaged on the car if you go for a settlement. Anything found to be wrong after that will certainly result in the owner denying liability. Then your screwed.

just a thought.. i dont know canadian law,..but make sure they cant find some loop hole such as.. they inspect the car and say its owner responsibility because you are lower then stock ride height .. but on another note.. call him every day and ask for an update,.. dont let him hush hush you.. he is worried..trust.. if i were you i would find someone you know that is a lawyer or find one and have them give them a call.. also.. now that im thinking.. maybe you shoulda filed a police report...this is a tough case..g/l

speaking of AMC plaza.. there is one @ Highway 7 (woodbridge/vaughan area)...same issues, last time they had a full window (driver or passenger not sure)just left there and some smart @ss decided to break it in pieces and scatter it all over the parkinglot...

another reason why it's crazy up here....but what can you do

Hello again,

Trying to get in touch with you folks is like mission impossible. I have contacted Tamy BROWN in regards to the damage that was caused to my vehicle. I have attached a photobucket link for you to see the pictures of the curb that damaged my vehicle.

This is fairly simple, someone neglected to remove the curb from the lane way between the former "OutBack" and the new Milestones. This curb was practically invisible at night and it cause a large amount of damage to the under body of my car. One of the shift managers at AMC Whitby advised me that PenEquity is directly responsible for the parking lots and property at the plaza and that their contact is Tamy BROWN.

I attached a picture of the repair quote from Midway Nissan in Whitby as Tamy requested. They are in the photobucket link. Folks all I want is my car repaired, nothing more, nothing less.

I would much rather deal with someone at your company then to subpoena everyone at PenEquity that I had emailed so far in regards to this incident. It seems getting a response is very difficult here.

Please contact me before the end of the week as I would like to resolve this issue.

No buddy, I don't want to get my insurance involved in this.

I have a great track record with low premiums. I don't want to give them a reason to shhhhhhcrew me with higher rates.

If it comes down to it, the insurance will cover it, but I'm 100% sure they will go after them on their own accord.

You would be surprised, as there are many loopholes in the law. At the end of the day, the property insurance will settle the claim because it is much cheaper to do so rather than use adjusters, lawyers and other resources. They come out cheaper paying him a settlement. Kamski, like I said earlier, please make sure you check everything out before you settle.
