Steve Lima aka CALIHEAT- buyers beware

Just so you guys know.

I have been e-mailing Caliheat about buying a x50 radar detector. That was the title of my first email to him. We worked down to 215 but when it arrived, it was the 8500, NOT the newer x50 as he agreed via e-mail. The other confusing part was that I was cross shopping for the x50 on another thread but regardless, I was having an x50 conversation with Caliheat over email...

I realize that he was confused because he was trying to sell both 8500's he had, however, I did not pay for the 8500, I paid for the x50. But did not get it.

So I was willing to send it back and have my money refunded. Caliheat refuses to refund or even refund the difference in cost between the 8500 and the x50. I think this is bad business and you all should be wary of buying from him. Here is the conversation.

ME (in response to him e-mailing saying that he had one available): I am interested in the X50. I will give you 200 shipped for it. I am debating between this and an almost used V1 that I can get for 210 shipped. Please let me know. Thanks

Caliheat: ill do it for 225 shipped

Caliheat: one more left in red !!!do you want it 230 shipped

[readers NOTE: The above indicates that he was originally thinking about the X50 not the 8500 since the x50 is the only one with a color choice (blue, red), the 8500 is red only. Or he was trying to scam me from the start]

me:If you can swing 215 shipped you have a deal.

Caliheat: ok then paypal me at caliheat@msn.com ill send it out asap

Caliheat: got it thanks can you please provide a phone number if you want fed ex asks for it if not they just leave it there (Caliheat)

Me: ###-####

Caliheat: I SENT THE ITEM OUT ON FRIDAY SORRY I GOT DELAYED YESTERDAY HERE IS
THE TRACKING NUMBER VIA FED EX ############# EMAIL ME WHEN YOU GET IT

ME: As you can see, the original product you were selling was the X50 8500, NOT the 8500

Caliheat: I responded to a lot of emails and sent out a lot of pics and we must of gotten both our signals crossed I do apologise in advance but I can't refund you the money I don’t know what's he difference between the 2 but you still purchased a good quality radar I noticed that you were tryiing to buy one from another member and you thought that you paypaled him instead of me

ME: Yep, definitely crossed messages:

However, I never received any pictures, and there was no mention from you that you were selling the x50 vs the 8500. Therefore, from our e-mails, the product sold should have equaled the product bought. (regardless of the quality of the product that you actually sent.) I already have a passport 8500. Why would I want another one? I wanted to upgrade to an x50 which is what I paid you for and what you were advertising as shown in the email conversations I sent in the last email..

The difference between the two are that the x50 has 50% better K and Ka range, as well as selectable pop radar and has a different color scheme, brilliant red or blue.

Please refund my money and I will send this back to you.

Caliheat: sorry but I cant refund

ME: Ok um that's just bad business. And that will have to go in the sellers feedback forum.

Anyhow, I am willing to compromise. If you pay me the 50 dollars difference then I will be satisfied. I have seen the 8500 go for 160 on ebay WHICH IS WHAT I WOULD HAVE PAID had I know that was what I was paying for. Come on that is the LEAST you can do. Work with me here. Have some integrity.
no reply yet...

Moral of the story:
1) Buyers beware of STEVE LIMA aka CALIHEAT
2) I should have gotten the V1 for 210 from my friend

Sh*tty. And yes - worth posting here. He needs to explain why he can't refund you the money. And then to refund it to you anyways.

that's what I was thinking...

My hands are tied since he won't e-mail me back. Do you think Paypal will take my money back if I explain the situation?

File a claim with paypal. They will give you your money back if you don't receive what you were suppose to. which you didn't. I was thinking of purchasing some stuff from him but he seemed shady by only answering by a few words.

If you think you 've been scammed then why are you trying to make a deal with me and me refund you $50 just to call it even .I have responded to your emails so dont try to gain pity from the other members on the org to make this a witch hunt against my behalf you never asked for any pictures of what i was selling and you yourself thought you were dealing with another member and thought you paypaled to someone else.If i was tring to scam people i would not of started my own forum for feedback. The minute i sent the product out i emailed you a confirmatiion number via fed ex as well The product you purchased is still worth the money you paid

What the hell difference does that make? He ordered 1 thing [or was under the impression he was ordering the x50] and got something else! Period! There isn't a business that i have ever heard of that would not refund or exchange or at the minimum refund the difference in price. I am amazed at this situation and will certainly not be doing business with Caliheat. UNBELIEVABLE!

Why won't you let him return the item and get a full refund? Why should he have to resell something that you misrepresented..... Bad business and yes you have the same obligations in sales you make.....

I don't think it is a crime to post a name. Why don't you do the right thing and swap the radar detector for the one he wanted? Or just refund the $50. Don't expect to sell anything else on here.

Caliheat,

I tried to be reasonable about this by going through the normal avenues over email privately with you before I posted here.

I KNOW what an x-50 looks like because I've done extensive research on the product. You advertised a new one and thus I did not feel the need to ask for a picture.

This line sums it up in detail.

Caliheat: one more left in red !!!do you want it 230 shipped

As we both know, only the x50 comes in the different colors blue and red. So even in our conversion on email you knew that you were selling a different product than I was paying for. That is sketchy and devious.

The 50 bucks is simply a consolation for the difference in value between the two products. THAT'S ALL! I have no intention of selling this 8500. I WANT TO RETURN IT TO YOU! I already have an 8500, so I will never use the one you sent me?!? Unlike you, I am not in the business of scamming people. Period. In fact, I have never sold any product to anyone online ever so how could I scam someone?...

you said this:
caliheat: who are trying to sell products the product does sell for in the $200's so now he wants me to refund him $50 in a difference ?why is that? so he can take the new product resell it for over $200 and he makes an extra $50 bucks at my expense?.

so in saying this you are admitting that there is a difference in value between the 8500 and the x50. This is reason enough for you to refund the 50 bucks. And to make matters worse, you were originally trying to sell it to me for 230!!! So you just admitted that you were trying to make a profit of over 70 dollars by selling the 8500 to me. Once again, sketchy and devious.

You made an unethical choice of unloading your out of date product on me even though my emails CLEARLY stated I was interested in the X50 not the 8500. In fact, you claimed to not know the difference between the 8500 and x50 so I had to tell you (see my original post). If you are selling a product, it is in your interest to know what you are selling.

Why may I ask can you not refund the money? You have sold many things on the org. I did a search and came up with many posts where you have done business with org members. Clearly you have some source of income from these. You should at the very least be able to send me the 50 bucks.

Please refund my money in full so I can return this product that you never should have sent in the first place. Or if you can't afford the full refund, send the 50 and we'll call it even (Even though I am still getting screwed)

Oh yes, I posted here because other members on this forum should know what they are getting themselves into when they do business withyou. It is in no way to get pity from them. (I have more confidence in my decisions and opinions than to do that.)

thanks.

Assassin,

Careless of Rowan, not knowing who he's dealing with? I disgree - that sounds like you're telling him it's "his fault he got scammed" before we even give caliheat a chance to make good.

It appears though that we will all see what kind of person he was dealing with when Caliheat decides what he is going to do about this.

I don't get it. Rowan just wants his $ back and he will return the goods. No harm, no foul. It's clear he asked specifically for the X50. He might have asked the wrong person but that person also didn't note the X50 in the request either.

It's also odd that Caliheat is accusing Rowan of being some type of profit monger. ie.. asking for $50 and the reselling it. Well if that is the case, then it's clear that Caliheat can resell the unit. So I don't see the problem of refunding the $ and then reselling it. Because if Rowan can "resell" the unit so easy, so can Caliheat.

What is more likely is Caliheat can't refund the $ because he has no $ to refund.

I am fully willing to retract everything I've said IF he refunds the money.

I'm sure he has been a good seller in the past. He must have slipped up this one time (although I doubt it) and now is forced to with the consequences. Caliheat, please do the right thing.

Ban caliheat from the site and have the buyer file a complaint with paypal.

Cali its just wrong your not willing to compromise or make good on the deal. Hell just take the product back and resell it unless your one of those guys who cant afford to do that or the products hot or something. This is just weird..

Quote from Caliheat's e-mail to me:

"My answer is still no and after be being called a scammer by your self and others makes my decision final"

to which I replied:

"I only used that word after you refered to me as such."

I guess that claim with Paypal is going to be filed after all. I have given him due time to reverse his decision. Now I have no choice. Thanks for validating what I believe is right, those of you above.

Wow! So he is willing to lose alot of future sales he would have gotten here for $50 ? Sounds like someone you don't want to deal with in the 1st place. Thanx for the warning , sorry for your situation, it sucks!

Paypal claim filed. Let's see what happens. If people were more ethical, all this would not be necessary. It's a shame. Thanks for the support everyone.

um, just got an email from paypal:

"PayPal's Buyer Complaint Policy only applies to the shipment of goods, and to disputes about the attributes or quality of goods received through an eBay transaction. "

So even though the transaction was over e-mail and it was a paypal transaction, they can't do anything? If so that kind of sucks...

It sounds like Caliheat has made his decision, which is unfortunate for his future as a seller on Maxima.org. He does still have time to redeem himself, though...

One last chance, Caliheat. What are you going to do with it?

did you pay with a CC through paypal? if so than file a claim through your credit card, saying it was fraud on the internet, they sent you something that you did not pay for
