screwed !!!

yea well i just recently bought my 96 maxima gxe 5 speed a few weeks ago. About a week later I got my CARFAX from a maxima.org member (MAX7) and it shows that my car has 225--- miles on it. I run outside to see if my eyes are playing tricks on me to find out that for sure my mileage reads 107--- miles. Learning that i have just been played I search threw my records and papers on my car to see that i did in fact sign the car as is. Does this mean even with mileage fraud the car is mine and not nego for getting my money back? If anyone has any kind of comments, info, helpful somethin it would be apperiacted I hate knowing I have just had one pulled on me.

**** man, that really sucks. You baught it as is, that meens that it doesnt matter what he said about it or what you knew about it, it is the way it is... Try selling it and getting another one. How much did you buy it for?

Was this a dealer or private? Unless I'm mistaken tampering with mileage is a federal crime. Translation=they're f-ed. Maybe you can get them to give you your money back with the threat of going to the cops. Good luck!

Did you buy it from a dealer? Its definately fraud... its actually a federal crime to roll back an odometer. I wouldnt just go negotiate, I'd prepare myself by researching the federal law and how you can go about this. I wouldnt accept the car and would demand a full refund... if not go to court. Dont get suckered in by this crap.

Whoa at first I thought you were saying the car max7 sold you had 225k on it... (because he just sold his car, I know him) and I couldn't believe that because it's a 99 SE-L in immaculate condition, but then I reread what you said. Yeah it sounds sortof like you have been duped. I'd contact the previous owner and confront them with this info.

Did you purchase the car from a dealer or a private person ??

If you bought the car from a dealer you can get them for fraud and some serious problems...If you bought from a private seller, I would take them to court definetly....

Odometer Roll back is a very serious problem and a very serious offence...

100K mile difference, I think I would be able to tell a difference in the way the car drove...

$1000 down, 270 a month till 07/2006 - I mean the car is in prefect condition if it didnt have 225---miles on it.

Buyer beware.

I'd get a lawyer. I doubt the guy will offer you any money back as he'll probably plead ignorance as to the discrepency. You're gonna need to prove the car had 225,xxx miles on it while it was in his possession through inspection records or something. That makes him responsible for the roll-back. After this, then I'd imagine it's off to the court room.

Might not be worth your time or trouble but that's about it. Unless you just wanna go and kick his ****. But I don't think that's the way to go.

Start reading up on it and see who you can contact... especially if its from a dealer, chances are most of their cars are being rolled back. Contact your local Consumer Affairs Dept... I would be very very pis sed if someone sold me a car with that much mileage claiming it to be half. And for that much money please man its not worth the headaches you might have ahead of you.

So it's a dealer. I'm pretty sure they would rather settle with you than have their business completely ruined.

Another idea might be to get a carfax account and start running checks on other cars they have (at least if they don't give in right away).

yea i was thinking they rolled it back also but my cousin told me that his friend had a gmc truck of some sore and just changed the whole cluster therefore changing his mileage from 51k to 20k. I'm thinking this is what happened. Otherwise looks like im screwed and will be needed to replace this engine very very soon. And it drives fine no noises from engine, nothing at all I guess im screwed.

Dude is this a dealer ?i wouldint only get my money back id sue them for the crime rolling back an odemeter or in your case modifying is a federal offense take them to court and wiht a good lawyer and documentation you will win!

I mean my car was bought from a dealer but hes my dads freind also while installing my chrome gauge rings odemeter looked used not new also car fax says true mielage so i highly doubt my mileage been rolled back anyone know of how to find out for sure and what i really want to know is to contact origianl owner anyone knwo how to go about doing this??

well to top it off guys my cousin recently had drove my car and decided it was ok to wreck it cause the front, hood, and driver side panels to be bent/misshaped. I'm defiently thinking the dealer wont take the car back now its not the way it was when he sold it to me. So thats another spin to this situation. I'm thinking just fix the damn car get a new engine/tranny i have a mechanic to put it in. My cousin will be fixing the body back to new since it is his area of study and go about my business cause i dont think the dealer will take it back now. Or should i go ahead and do some legal things about this?

Too bad about the accident, you are probably totally screwed, Federal Law or not. But, on the other hand, it is nice to know the Maxima is so well made that it does drive like a 100k car.

is it salvaged? if so, they can reset the mileage in certain conditions....when you signed over the pinkslip you wrote in the miles on the dash right? when the person who sells you the car signs the release of liability it states something like "to the best of my knowlegde the above information is correct" but the porblem is it says "odemeter reading" not "cars actual mileage"....i dunno just research it some more....go to www.freeadvice.com create a free account and ask an attorney...they will help you out.

take the car to a reputablel mechanic and see if they can tell if the cars got 220k on it. any mechanic with a good eye will be able to tell...suspension bushings, engine mounts, engine compression, exhaust condition, any rust, oem axles, alternator, things that (more than likely) shouldnt have to be replaced before 110k but deffinatelly by 225k. double check the vin also. sorry man that sucks, was looking at a tacoma for a friend a couple of weeks ago and called in a carfax while we were looking at the truck, he was almost gonna get it...come to find out it had 15k less than the carfax said. hope you figure this out.

first of all, go to the dealer (no need to bring your car) and tell them that you ran a carfax on the car and the odometer mileage shows up alot more than what's on the car.

See what they have to say about it. Tell them that you will pursue legal action if they try to play it off and work your way from there. See how reasonable they are and feel your way through it....

but definately approach them with your discovery and see what they say about it. Since it's a dealership, they will not want their name ruined considering odometer roll-back is a big crime

I'm not sure about your state, but in Hawaii (and in some others) titles have a section that deals with odometer discrepency. Hawaii titles have a blank space for actual mileage, a box to check if the odometer has exceeded its mechanical limits and another box if there is a discrepency. Review your title to see if there is something similar.
If I remember correctly, when I tried to switch out my gauges (I have the black and wanted to put in the SE white face ones), I went to a local odometer recallibrator? to correct the newer SE ones and there was a sticker that was supposed to be placed on the vehicle stating the odometer was removed or whatever.
But regarding the incorrect mileage, it IS a FEDERAL CRIME. Something can be done to correct the situation. The dealer was either fooled or did the fooling, and I'm pretty sure would be willing to solve the situation to protect its name.

definetly high i paid 7 for my 99 which is in perfect condition with only 74 thousand miles just becuase it was a 5 speed and no body was buying it at the dealer i love lazy people.

i paid 8 for97 with 64k, but besides that, they didnt tamper with the odometer, the previous guy probably did.....but they are still at fault because they most likely check carfax before they took the car in, right?

Definitey, go after this dealership. Regardless of what happened to the car after you purchased it, the dealership owes you some money due to the mileage difference.

contact the bank you have the loan through... they also have a interest in the car!!! and if they find out that the car has had the miles rolled back, many banks will provide you with one of thier lawyers and a** rape the dealer and also never work with him again. your best bet is to contact the bank, because if the bank does not want the car to break down before you have paid it off.

wow didnt think this tread would get this much responses. Yea so I called the dealership and the salesman no long works there and the owner wont answer his phone. This dealership is owned by 3 people. I guess it isnt rosewood color but it is a red color of some sort and defi looks like rosewood to me i dont know maybe im color blind. Thanks for all the input guys I will defi proceed with legal action. Somebody said something about salvage title cars they can roll back the miles? If so where legally does it say that thanks in advance.

If the vehicles odometer is incorrect, you should have received an odometer discrepency statement that you have to sign. They probably threw it into your paperwork and got you to sign it with the 20 other papers. A dealership in NM tried that on me with a 77 blazer.
