is this a moving violation?

is this a moving violation?

I got a ticket for cutting through a gas station and making the right turn to avoid the light and traffic.

The citation says "Evasion of a traffic control device".


I don't mind paying the ticket, but does anyone know if that violation carries any points? I"m in Virginia by the way.

I got speeding ticket in January too. I hope the insurance doesn't rape me.

Do a quick search of you state stautes--found at your local library or online at the official Virginia Gov. website. The ticket might have the code for the statute the officer said you violated, doubtful though.

I've seen it issued here in GA before. Kinda BS, but it is dangerous here...idiots abound.

yes it is a moving violation. i dont know how many points though, that goes by state. i guess its illegal because they think that if you cut through you are in a hurry to beat the traffic light u just evaded and your more likely to "cause" an accident in the parking lot or pulling out. it does kinda make sense when u think about it.
but i do it everyday on my way home from school, traffic is nuts. i have yet to get a ticket for it

whoa! i did that... but i wasn't avoiding the light. I was avoiding the idiot who decided he was better than everyone and blocked the turning lane while he waited for a space to open up for him even tho the light was red for the lane he wanted to get into!

That's a new one, i should watch out for that.

Buddy of mine here in TX got a "trespassing" ticket for doing the same thing. Go figure....

It's not tresspassing. The officer just didn't know what the hell to write on the ticket. Must have been in Houston.

In TX, the actual title is:

Cut across private lot to avoid traffic control device.

I'm a cop by the way.

Dave, How do you have time to respond to this post. You are supposed to be out there catching bad guys. I guess they don't have to many bad guys to chase over there in TX. That is unless you're on the border patrol.

you know on Maple Avenue near Tyson's corner, near that big toilet bowl building?

It was at the intersection of Maple Avenue and Old CourtHouse Road. The gas station is Mobil.

yes its illegal, but technically, if you pull into a gas station with the intent on pumping gas, and lets say, you 'accidentally' forgot that you already had a full tank, and say outloud, "oh what do you know, I don't need any gas at all" along with a quick pause in front of a pump, and then continue on your way and avoid that light. It COULD be a loophole

Or you could just say you were gonna do a driveby but noticed you forgot your gun. Might work just as good!

I love it when people try to justify their way around the law.

That would only work if you got out of your car and started walking toward the cashier then turned and got back in your car.

The bank at the worst intersection for that near my house put up a sign "Using this parking lot to avoid a traffic light is a violation of statute RSA-xxx and is punishable by --- " ... I'll get the number and punishment when I bring the kids to school, but it'll only apply to NH.

I got a suggestion, just tell the judge that you were pulling over to answer your cell phone, and didn't want to cause an accident, then once you went to pull over to answer the person hung up. This way it shows that you were responsible that you didn't want to talk on the phone while driving.
