Legal Question

I bought my Maxima a little under 3 years ago. I have found out in the last couple of months that although I was told I was getting a nissan security plus gold plan I actually got the lowest extended warranty avaiable. To make this worse the next step up was only $100 and covers 400 more parts. I don't understand why these guys would sell me the lowest warranty if I'm willing to pay for a much better one. I now find out that the warranty they sold me, the one they presented as being the only warranty available does not cover my upper bearing assembly but every other warranty does. Add to this I just found out 2 days ago that my car had been involved in an accident before I got it and was never informed of this by the dealer. I have contacted 1-800-NISSAN1 but they won't do anything about the warranty and I'm still waiting to hear back from them about the accident not being reported to me when there was a police report that was 2 years old when I bought the car. Does anyone know what my legal options are here and what I should reasonable expect.

For the warranty - probably nothing unless the original sales documentation says you ahve something different. When I bought my car, I spent 1 hour reading every single little bit of fine print. When thousands of dallars are at stake, you should always do this.

For the wreck, it's been too long, and the "Lemon Law" (which I THINK is 90 days, someone correct me if I'm wrong) has passed.....so you probably can't do anything there either.

What can you expect?

You're either going to pay a lawyer more than the value of the car to get this straightened out or you're going to pay extra now for the extended warranty you didn't get then.

Either way it's been too long, sorry.

Pay a lawyer for what? To straighten out what? The general public needs to understand that though lawyers generally excelled right through undergrad and are good test-takers, 99.44% of the time they cannot reverse situations just because. Didn't we just go through this matter recently with the bogus legal plans offered through employers?

There are many situations where you don't have to get into legal mumbo-jumbo to come to agreements. That's why it's a plus to deal with reputable people. Now in the car business, it's understandable there aren't many.

Depending on what he signed there may be a way to straighten it out in his favor. I doubt it, but he's going to have to pay to find out.

My point, which I guess I didn't make very clearly, was that he's going to get screwed because he waited too long to do any research.

In purchasing an auto its "buyer beware". Unless your paperwork states you purchased the gold plan and your car was never in an accident, then theres nothing you can do at this point. Whatevers in writing will take precedence over any verbal representation.
