Well.... The SkyBlue 90 SE is totalled. What happened? I was driving on a 2 lane highway and it was raining very heavily and some guy in a ford explorer was merging into my lane and he slightly hit me and my car lost control at 45mph and swerved over to the passing lane, hit the side rail, did a 180 spin and slid some more and did another 360 spin. My car was facing the opposite direction in which cars going 60mph were heading right for me. The other cars almost caused accidents trying to avoid hitting my maxima. I tried to drive the car out of the road but it wouldn't. The front bumper is cracked and hit pretty bad, the driver side fender is messed up, the front bra cover is ripped to shreds, the hood is slightly bent, the driver door is a little damaged, the front driver side wheel completely ripped off with the strut, spring, rotor, and brakes. The rest of the car is untouched. I called 911 on my cell (since nobody bothered to stop and ask what happened or even offered to help). My friend saw me and stopped and asked if I was okay.. I wasn't hurt too bad. I could walk. I was on my way to class at my college...well, lets just say I didn't make it. 4 cop cars showed up... asked for license, registration.. blah blah blah. Asked if I got the license plate number of the ford explorer.. Hmmm, lets see.. I'm spinning in circles while the guy in the ford explorer is driving away (probably laughing or didn't realize what had happened).. it's a little hard to get his plate numbers. Since I didn't have the license plate number the cop said the accident was my fault. This is just great. My insurance company won't pay me any money because I do not have collision covered on my maxima (couldn't afford it). The tow truck came and took the maxima away. So now I'm screwed. I have no car, no insurance money, and no witnesses. So what am I going to do now? I was thinking about buying a cheap car (I only have $1500 in my bank).. maybe a CRX or GTi.. of course 5-spd. I took about 10 pictures of the accident. I will probably get them developed sometime next week so you guys will be able to see what happened to my car. I wish I could buy another maxima but I can't afford it... so I guess my reattempt to Turbo my 3rd gen this summer won't happen =( This really sucks... I was looking forward to that project and going to future Maxima meets and let all you guys see my custom mods. I'll probably stick around the BBS for a little but not much. damn, I feel for you. Where do you live, doesn't seem like a very freindly place? No one stopped?

I wish you the best of luck. Maybe we could start a fund with maxima owners here to get you back in a max. Depending on how many registed users, it would only be a few bucks for each of us. I'm game, we can't let you go Honda on us

I'm glad your okay though!

Talk to the insurance company and explain your case. Or at least put some ads in the paper asking if NE1 saw the accident. I see people doing that all the time.

That's a freaking hit and run. You should fight this. It wasn't your fault, and you shouldn't take the blame. I hate irresponsible people. Causing an accident, and just drive off like it's nothing. Although, it's not going to be easy to fight this one because you didn't get the guy's number down(which you couldn't, unless you have super vision or something.) Still, FIGHT IT!

i hate it when police are unreasonable. but i think that is probably procedure. (ppl make up stories) so they used the statistics against u i guess. well next time u see a explorer thats a lil banged up and the person is an A$$ then go OHHH YEAH u knwo what i just remembere the plat number was blah blah blah blah.. not like that would work but.. man don't go honda on us. for reals. they are nice cars but a max is still better. in terms of 4 door.

as far as cops are concerned (in most cases) its always you fault. i know someone that happened to get to the street races in milpitas on his way somewhere else. his car is a totally stock 90ish camry. they ticketed him along with everyone else there. he was only there cuz he couldnt get through the crowd. the cop wouldnt listen when he tried to explain. whatta d*ck.

I live in Reading, PA. I am guessing around 200 cars drove by and just stared at the accident and didn't stop. Well my friend stopped (since he knows my car). Oh and some guy in a hooked up Accord asked my friend if anyone called the police yet (I was talking on my cell at the time). But other than that no one seemed to care. It was raining very heavily too and I had to stand there on the side of the road for 45 minutes getting soaked. I appreciate your concerns but about a max fund.... that would be too much to ask. I'm not sure if I would be able to accept that. I might consider buying an SE-R or 240SX just so I'm still part of the Nissan family..hehe but it's gonna be hard to find one for a good price.

My mom saw an accident.. she was witness and took the license plate down of the guy whose fault it was.. hit and run... just in case she did see an add in the paper!

you never know! if my mom thinks of it, i am sure other mom's would too!

she never saw an add in the paper... but hey she was ready

sorry to hear that happened,ifeel for you,but i hate irresponsible f--kin drivers who dont give a sh-t especially the ones in suv's, those a--holes never pay attention to the other cars when they make any moves,that just kills me especially with me being a cautious driver.......to top it off the friggen insurance company is never on your side.....like they are doing you a favor......you are paying those *******s,i am glad that there are people out there ripping these companys off...they deserve it......please stay maxima,dont downgrade on us........keep in mind that sh-t happens for a reason.........GOOD LUCK SKYMAX

failure to get a plate does not exclude you from pursuing a hit and run accident. you need to call right now and file a police report. Ins companies pay from police reports. If you wait to file one, you will lose your ability to get any help from the ins company. You should call the police department. Tell them you were very shakin up from the accident, perhaps alittle light headed and were not able to argue with the police officer regarding this. The ticket you have will not go away right now, but if you file a hit and run report, the judge will prolly lift the ticket when you contest it. Just tell them you were dazed and the cop was not very helpful. Stand your ground, you have nothing to lose by being a pain in the *** and pressing the issue. If you can get a report opened on this, then let the ins company know.

Sad Sad, that's just wrong. No one stopping to see if your ok. If you still want to go to E-town, I might be able to pick you up. I'm still finalizing(sp) the details w/ my sister. I found out yesterday, that she is going to Boston that weekend.

The police already filed a report at the scene of the accident. The cop said that the accident was my fault since I didn't get the other guy's license plate number. He must have thought I was making up an excuse or something. Also, there is no damage on my car from the other guy, just a small dent. The guy with the explorer has a dent too on his door but he'll probably fix it up within a couple of days and deny everything that happened. Not a good situation for me...

Sorry to hear that...

First thing I would do though is try and post an ad and hope someone notices it. Then I would definitely appeal the situation in court and hope the judge helps you out.

The reality is that indeed there's very little you can do about getting the other guys info. Sorry about your loss, but at least you are ok, and walking. Got to be extra careful in the rain.

bro i know this might sound REALLY bad right now...but if you're going to get rid of the car then why not sell some of the mods and etc to get some $$ for the next ride?

Nevin I think your insurance company is talking ****. I hit a big A$$ water buddle with my car where they were draining a fire hidrant, and my car spun and hit the curb, my front rim was bent, the strut was bent, the hub cracked, the spindle bent and some other stuff down there. I told the insurance company about that crap b/c the bill was like $1800. I didn't file a police report b/c I was like the hell with it, what am I gonna tell the cop I hit a curb? the only thing the insurance company asked me was where the accident was, what time, what date.. I think your Insurance company is d---ing U around here. when U go to court tell the judge what happined and maybe he can see your side of the story. COPS ARE A$$HOLES at times. Just like when somone Keybed my 4Runner, I called 911 then and the Cop that showed up asked me if I had pissed someone off today that they did this? I told Him I parked this **** here, went Inside Wal-Wart and when I came out I had a big A$$ key scratch on my door. he filed the report anyways and the insurance paid for that too. I'ld fight it man. I know U R doing everything in your will but Keep trying hopefully it'll workout.

Hey Nevin, as you know, the important thing is that your ok.
I know how it's like to loose a car you really like, it has happen to me too many times to count. Try to stay positive. Fullfil your needs, then worry about your wants. Get trough school, find a hot girley to drive you around for a while.

Have fun, enjoy life, it was just a car.

Get a copy of the police report.

Find out from a lawyer or somewhere what the laws are in your state regarding hit and run. Check your car to be sure that you didn't take some paint off of the truck when he hit you. This would help support your story.

In NJ, there is a provision that allows us to sue our insurance companies for losses caused by another driver that failed to stop, even if the other car never touched ours. Maybe your state has a similar provision. Be sure to read you insurance policy for more info. Find a good lawyer and tell them your story. Write everything down as soon as possible so you have time to remember all the facts.

Don't worry about what the cops say. The don't care about anything since it's just more paperwork for them.

Like everyone, I feel for yah. Sorry to say but even if you find the guy, you don't have collision so no pennies there. That's the way the cookie crumbles. You could file a report with the police and put an add. Someone is sure to see it. Since you didn't get the plate numbers, to the police, it can be a made up story so therefore they have to put blame on you. Stupid police, all they do is cause more headaches and cost you more money and they get all the credit, f__k'em!!

Sorry to hear about your loss. . . I know that you had put a lot of work into your car.

I know you don't have the plate number, but don't you at least know the color and stuff like that? I would just try and post an ad somewhere, or (depending on the size of your city) you may be able to get it on the local news. Someone had to have seen it, and knows what happened. . . The sad thing is most people don't report it to police unless asked. It is the sad state of the world today.

I'm from the same area as SkyMax. Last winter my car slid off of a highway exit/entrance ramp. I slid about 200 feet sideways and ended up with my car pointing towards the ramp but on a small hill so I couldn't drive back onto the road. As soon as it happened I called a tow truck to pull me out. I was waiting for the tow truck for about 30 minutes and hundreds of cars drove by - well maybe around 100-200 cars. No one seemed to care. I was standing outside of my car trying to figure out if I could move it and people just drove on by looking at my situation. About 1 minute before the tow truck came a young guy in a pickup truck stopped to offer me some help but by then the tow truck arrived. I finally got out of the ditch and was ready to leave when a cop arrived on scene. To make a long story short he left me off. The reason he left me go: he did the same thing a year earlier! Some cops are cool and don't have major egos to fluff up.

Really sorry to hear about your misfortune. We all know what our cars mean to us and how it feels to have one wrecked due to no fault of our own.

The ad in the paper sounds like a good plan but do it asap. I am surprised that no one stopped and wanted to be a witness, I know I would. I know, because my accord got totalled in 97 when an idiot hit me. A few people on the spot stopped over and were good enough to wait for the cops and be witnesses, that really helped my case. Of course, the a$$hole who hit me stopped too ... that helped!

Don't take crap from the cops, put in an ad and hire a lawyer if you can. Do you have any lawyer friends of the family. These insurance companies suck big time and the cops don't help either!

I would agree with one of the other people that posted.... I would salvage as much mods and stuff as you can and sell them, that will at least get at start towards your new ride. I am sure that many of the people on this forum would buy most of the stuff that you have.

That really sucks...

Kind of reminds me of my accident. On July 4th, I was coming home from my mother's cookout and was also on my way to go see the fireworks. I get just a little bit down the road, when some lady in a Corolla comes around a curve fast as hell, loses control, and slams right in the rear drivers side of my car. I went into a double 360 degree spin, and ended up with my car in the woods. I had no rear door, and no rear drivers side wheel. About three windows were shattered, and half of my stereo and the contents of my truck was missing. I wasn't too badly hurt, she had a ten year old boy in the car, and his ankle was hurt. She had no front end and no engine left. Both airbags deployed and her front windshield shattered. Yet she told police that she was only doing 35 mph, and that I pulled out in front of her. The officer knew she was lying and administered an alcohol test. She was legally intoxicated. After investigation, they confirmed that she was going approx. 110 mph. Guess what, my insurance company said that the accident was my fault because I didn't make any evasive actions to avoid the accident. They refused to give me the value of my car. I'm in the middle of a lawsuit now. I had to buy another car out of pocket.

I work for an insurance company (life insurance) and I know that we don't **** people over like that...

They make it sound like you WANTED to get hit by some crazy chick going 110mph WTF are they thinking?!!!!!

Some companies are just pure crap... I would sue them for much more than the value of your car.

Man I wish I had paid attention in Business Law when I took it... there is actually a name for what you would sure them for... Tort of Bad Faith or something like that (it's been a while)... anyway, I hope you bend them over and grease them up good, they deserve it!!!

Guess what, my insurance company said that the accident was my fault because I didn't make any evasive actions to avoid the accident. They refused to give me the value of my car. I'm in the middle of a lawsuit now. I had to buy another car out of pocket.

TimW is right check to see if you have Uninsured Motorist Coverage-->>

This is what you should be using until a culprit is found.

Just put an Ad in the local paper

Hopefully I will get a positive responce from the ad. I just wanted to thank everyone for their support.. you guys are the best. A mechanic is coming to see my maxima today to get an estimate on the damages. If it's under $4k then I might consider keeping the car. We'll see what happens... but for now I must go car shopping. Thinking about an older legend, crx, 2nd gen integra, 240SX, older celica, or maybe I might get another Z31 300ZX Turbo.

Hey I've hung out in Reading before.. seemed lonely but not unfriendly, hm.

This sucks, your need for justice is understood, especially since you don't want an at-fault accident on your record. I hate to sound like a ****, but look on the bright side here, you could have crossed the center lane and hit a family in a minivan, then you'd be at-fault plus have a $1MM lawsuit on your hands. I mean, it sounds trite, but this could have been so much worse with all that traffic.

I agree you should put out an ad, it won't hurt.

I saw a guy in a FOrd Explorer, right in front of me, on 295 North here in Portland (pretty busy road), merge into the passing lane, hitting a girl in a Jetta, and sent her into the median area where she flipped, crossed the oncoming lane ON HER ROOF (there was like -- a miraculous pause in traffic) then went into the gulley on the OTHER side of the OTHER SIDE of the highway and flipped again. She had her belt on and she was bruised but pretty much OK. I was in my Max then, and I stopped and pulled over (got my car stuck, but hey.) The old guy in the Explorer stopped like a half mile up the road and came back and asked if it was ME HE HIT. He didn't even know about the poor girl on the other side of the highway. What a dumbsass... people just suck and do NOT pay attention on the road. It's dangerous to have these people (especially OLD people) wandering around on the road aimlessly.

I would not be surprised if you had a similar situation, where the driver was older and didn't even really know what happened.

Hey man, what about using the $1500 for a down payment on something? Or do you not want to borrow? Or income? WHatever, just a suggestion.
