goin back to work from break...making a left on old country road to get into Westbury mall..sports authority, costco, kmart. 8:20 pm tonite. green light so i could make the left. look at oncoming traffic...a cars on the extreme right lane, and its a right turn only..so i figure hes gonna slow down and make it and ill follow him in or take it if he lets me. so im making the left, and the @$$ decides to SPEED UP AND MOVE LANES..hits my passengerside door and back door, car spins, hits another car thats waiting at the light..and the damage..wow. dented side..around 3 inches deepp..SCRAPED ALL OVER..busted..back bumper..shattered..my driver side..all shattered or dented in to the oil cap. time to call geico...checkout the deal wit this all. this is gonna suck. im ok thoug..bruised knuckle and thigh

oh yeh..the "witnesses" who were waiting for the green on their side say that the guy was coming straight and i was taking a turn and he just hit me..simple as that. they didnt even talk about lanes or NOTHIN..just that he was goin straight on the lane thats SUPPOSED to go straight.

But atleast you're okay. Everytime I would show my friend with a 2000 Maxima the Ninja kit (to persuade him), I would show him your car. I loved looking at your car man. But hey, sh*t happens right?

Now that sucks. The witnesses might lead you to a at fault accident. But on the +ve side, you are okay. Car and money are replacable but you aren't.

BTW I had an accident last December when a moron pulled out of a McDonalds and stopped in both the lanes in the direction I was travelling. Totaled my Quest and the whole thing went to arbitration. It got resolved just last week and I was not at fault. But then I did not have the kind of witnesses that you have. I guess I was lucky!!!!

The problem you will most likely have is *proving* he was in the turn lane and then he changed his mind and went straight without signalling his intent to go straight. What you need is a witness that can say he was in the turn lane, signalling to turn and that he changed his mind after you entered the intersection. HOWEVER this will only help you if the lane you were both going to turn into had TWO LANES and your state allows both oncoming cars to turn at the same time into the closest lanes (left turner takes leftmost lane, right turner takes rightmost lane). If this is the case AND if you can prove he was taking up positition to turn right, then you can claim that you did not infringe upon his right-of-way because the turn you made was legal even though he was already there, and that you excercised all reasonable care to try to prevent the accident.

If your state does not allow both to turn at the same time, or if your were both turning into a one-lane road then you may be judged to be at fault regardless of his apparent intent to turn, because he has right of way in the intersection until he has cleared the intersection, regardless of if he turns right or goes straight. You can't proceed halfway through the intersection, blocking oncoming lanes, and wait for him to complete his turn - I think you find you local state law requires that you stay in your 'waiting to turn left' position until the intersection is clear.


It's unfortunate that what may have seemed like a prefectly acceptable maneuver at the time may turn out to find you at fault... A similar accident with similar "He was going to turn" claims happened when a car pulled out of a side street into the path of an oncoming car. I have personally witnessed this twice. In both cases the person who pulled out of the sidestreet claimed the other vehicle had signalled to turn into the sidestreet they were pulling out of, so if they had completed their turn as indicated the accident would not have happened. While giving my witness statement to one cop he asked me if the car was signalling to turn. I answered honestly; "I don't know." The officer replied; "Not that it matters, really. If he actually started to make the turn, then changed his mind and turned back out of the road and struck the car pulling out, this things would be different, but nobody has suggested that so it's just a case of ignoring the he-said-she-said stuff which we cannot resolve here and go with the known facts - car A was travelling on the road, car B pulled out in front of him and the cars collided." Case closed.


I hope you can find a witness. Another good reason to have a disposable camera in your glovebox. Not only can you photograph the scene and the relative positions of the cars, but you can also take photos (immediately) of all the cars that might have seen it, and anyone who doesn't come forward as a witness can be traced by the cops via their licence plate numbers and asked if they are willing/able to make a witness statement.

 

thanks for all your support..it helps alot. i called geico this morning and told them what i know. the inspectors going to come to my house on the 3rd to checkout the car at my garage. i think i'm going to try to fix it up at the shop. both sides, bumper, and rear axle might be cracked. as far as mods go..forget speed, and all other things. im just real happy im alive. i got real shook from it all. cant even look at my car now..it freakin hurts

I'm an Adjuster with AAA insurance, and Geico is pretty good at payouts, so hopefully the damages will be less thatn $20k or else they'll total out your car, but thats not a bad thing, I'd just go and get a 2k2 6spd! and find a new kit for that baby.

Anyways you guys can message me if you have any questions about the claims process. I'd say you open up a MP claim and a bodily injury with the other party and get some money for your pain and suffering. just make it seem realistic tho. Think about your max when you are at the doctor and you'll feel the pain.

 

He just left like 15 minutes ago. looked at the whole car...told me that i should re order one of my side skirts and the back bumper ninja kit through the bodyshop i choose. lol. i guess he likes it too. theyre not gonna total the car cause its a 2000 and he said that it still has a lotta value. a whole lotta works gonna be needed..but it should be out for spring 2k2. dunno what kinda mods ill be doin later on..but at least it all can be fixed
oh yeah..there goes the 13 more days i have til school. i have no rental insurance

Make sure that the money for returning the frame to factory spec is included in the estimate. I definitely saw damage to the frame.

sorry to hear but cars can be replaced, you can't be. I had a somewhat similar accident but the car that hit me was a truck and traveling at a decently high speed, going to court soon wish me luck. Hope they don't take forever to fix ur car.

I'm glad you walked away with minor bruises. Just hang in there and everything will work out. Since the insurance company is picking up the tab, make sure you have the body shop use all OEM Nissan parts for the repair.
