Personally, I'd be really surprised if it was. Was nearly t boned by a girl who completely blew a red light ..fortunately everyone was OK. It looks like the frame is definitely bent a little bit. For getting hit by another car nearly going 40 MPH, the Maxima held up greatly, everyone in the car was perfectly fine. What does everyone think?

40mph side impact is instant total for sure. Glad to hear that you are ok and the max held up. Speaking from experience, the thing you should worry most is to seek treatment and not the car. Luckily I had side curtain airbags so my head was fine but my neck and back got messed up. Go get MRI asap.

Sorry, looked like the loaded into the initial post but I guess not. I added them to an album in my profile if you guys want to take a look. Tbh, doesn't look as bad it sounds. Fortunately I was able to brake just enough to avoid being t boned and the wheel and front side bumper took all the damage, although the back end also took some damage too. I think the max did remarkably well. Her car almost lit on fire

Also, it's very hard to say just how fast the other car was going. I honestly don't really know. It should have been around 40, the speed limit was 45 on the road. But anyways, I think it'll be fixed.

it doesn't actually look that bad, all things considered.
You've got a 7th gen, so the threshold is higher on what dollar value is going to be considered "totalled". HOWEVER: The impact is to the front end, crushing the left front. Front end collisions are extremely tricky to get right and fix 100%, just so you know.

With your Lease, actually.
It covers the GAP between what the car is WORTH and what's OWED on the car in the event of being totalled. If you owe 20K on the car, and it's only worth 15, when it's totaled they cut a check for 15. Without gap, you're on the hook for the remaining 5k.

Well I've had it for 6 months and have put 9000 miles on it. It had all the options and was priced msrp'd @ $40,700. I think the price I negotiated for the lease was around $36000. I'd be stunned if the gap was negative.

If your car gets totalled RIGHT NOW, how much is it worth? I guran-damn-tee you it ain't 36K. The difference in the amount the insurance company will cut the check for and the lease amount is the gap. Gap insurance covers that. If no gap insurance, you're OYO.
If you don't have gap, then hope to hell they don't total it. But if you could post up bigger pics that's help, immensely.

Anyone have any experience in regards to this? I assume the car will eventually be moved to the Nissan service center for repairs. Will they give me a rental car? I bet this takes 3 weeks to fix. My insurance company won't pay for a rental and I need a car

It's very hard to see from the thumbnails. Did any of the bags go off? Is it just the angle of the picture or did the rear quarter panel actually got damaged? If only the front got damaged, I don't think it's totaled considering you got a brand new car with a high sticker price. That might have been a 40mph impact but it seemed like she only clipped you, so luckily you and your car didn't absorb the full force of energy.

Yeah, even on the high end i'd suspect you're still below $7000 damage with the front and rear damage and no bags going off. You'd have to push close to 70-80% the value of the car or have serious structural damage before they would total this. That car is fixable all day long.
As to your question what next, that's up to you. The car goes to where you want to get it repaired typically. So find a place, let the insurance know what you want to do and they will move the car, either they or the shop will provide the estimate, insurance cuts either you or the shop the check. I always get the check in my hands, because then you can negotiate the job at the shop and keep the remainder.
And how did you get a full coverage policy without getting rental coverage???? That addition would only be like $20 per renewal, (either 6 months or 12). You realize that's going to cost you a bunch at the end of 2-3 weeks! You'll want to go after the at fault insurance, get reimbursed for that.

I've still got it
I worked in body shops out of HS, and I got a pretty good perspective on the business. First off, they nickel and dime every hour of labor, especially on the paint prepwork; and parts ain't cheap. With that estimate, 7-8k, i'm betting they put in cushion to cover your rental which will run probably $400-$500 after 3 weeks, so it won't cost them much from the profit of the job, and you'll be a satisfied customer. Hopefully their work is worth it all!

On my 07 when it was hit, the most expensive part was the left front light, it was $900 plus. and it was included with a front door skin, left fender and the left front wheel,control arm. strut etc. total cost was close to 9k.
