First Ticket = $335!
First Ticket = $335!
Ok i was going home from school keeping up with the car in front of me. A cop going in the other direction puts on his lights as soon as he passes the car in front of me. The car in front of me ( a grand am) immediately pulls over w/ his blinker on. So I move slightly to the left to pass him and my tires may have crossed the double yellow line, but only to avoid hitting the car that just pulled over. I look in my rear view and see the cop pass the grand am and come after me. So he pulls me over and walks up to my car. As soon as i roll down my window, he says to me "Hello Mr. O'Neil, is that your twin brother sitting next to you? " which it was. So this guy new me, and i HAD NO CLUE who he was. Anyways, he ends up giving me a ticket for going 66 in a 40 zone, and throwing another $100 for crossing the double yellow line!
Anyhow, i am DEF. going to fight this in court. Any advice? besides not to speed?

Why pull the other guy over and give him only 1 ticket, when you could give you two?

SORRY BRO!!! GOOD LUCK THO..LET US KNOW WHAT HAPPENS!!!!!!
The reason for you getting a ticket instead of the Grand Am is because you had two violations that he saw. The other reason is that it sounds like your brother has been in trouble before and since you are twins he recoginzed the face driving. When you fight this the judge could say why did you cross the double yellow. You probably will respond so I didn't hit the car in front that was pulling over to the left. The judge will probably say then you were following too close and not dismiss that violation. The only thing I can say is be honest. If you BS around he usually figures it out and will have no lienency with you. It doesn't hurt to try to fight it. At least you tried.

Yeah. How about go look up those posts of all the people whining about how much their insurance costs so that 1) you can start to whine too and 2) you can tell them first hand why their insurance is so high.
If you dont want to pay the fine, dont do the crime.
Hmm

If I understand your story correctly, the police car was moving, and it was coming toward you. Also, you were close behind the Grand Am.
With these facts, I'm not sure he can make a good speeding case against you. He would have been using a moving RADAR as opposed to LIDAR, which means it's very difficult to single out one car. With the Grand Am obviously speeding in front of you, you ought to be able to establish reasonable doubt that he was able to get a read on your car as well.
As far as the yellow line, did you slow down (I mean below the speed limit) before passing the Grand Am? That may make a difference.

Even if he (police) did not get a direct 'bead' on the car, if the Max and Grand Am were travelling close enough to have the Max pass it, they obviously were travellin at the same speed (or very closely). Whatever registered on the 'gun' is applicable for both vehicles. It does not sound like the Grand Am was speeding away and leaving the Max with a widening distance.
