HELP!!! Took delivery of new car. Discovered it had damage. What now?
HELP!!! Took delivery of new car. Discovered it had damage. What now?
What to do? Week ago I bought new 2003 GLE. Today when I was washing my car I've noticed that around left fog light paint is not smooth(actually it's rough). Almost all left side of bumper is like this. There also couple of deep scratches under the paint. It's definitely was painted(and who painted it was cretin for sure). Looks like somebody just sprayed paint.
Should I talk to dealer and if yes what to say. Should I call Nissan about it?
Thanks for advise.

I have heard of cases like this before..
Its going to be a really tough battle. But you must first contact your dealer and take it from there. There may be a possibility that you need to contact a lawyer!

Let them know ASAP...I found a mar on my car a few weeks later, (inconspicuous spot) and they said the timeframe was not conducive to them honoring any fix-its for the vehicle we accepted.
Before I took delivery, I was out there doing a "police crime scene exam" on every physical spot on my max before I signed those papers. Got on the ground and looked every which way. Luckily, it was a nice sunny day in the afternoon, so that helped alot.
Like everyone else has mentioned, I'd take it back to the dealer.
Good Luck!

Isn' there a law that states that the consumer is allowed to bring in the car for full cash value back or exchange in the first 48 hours or something?
I think for the law to apply, there must be something wrong with the car, which there is, so just tell them you want another car, or try to get them to fix it and give you some free goodies for your car for the inconvenience.

I've heard of many cases where minor damage during shipping was fixed by the dealer but not disclosed to the customers. It may depend on your state laws but the dealer may not be required to disclose damage under certain amount. However, the repair should be of quality indistinguishable from the factory finish. As Maximax2 stated, the good thing is that the damage was only minor and on the plastic bumper so it would be easy to take the bumper off and have it refinished professionally.
Sorry to hear about your new car! My advice to you is to try your best to work it out with the dealership. Get it repaired professionally (the right way) and have the dealership pay for it. If they're not willing to do anything for you, I would retain an attorney. Keep in mind, that it's possible that you're fighting against time, who knows what the statute of limitations laws are on these kinds of situations.
Also, if it goes this far, I can get a lawfirm to help you out for an extremely affordable rate. Just let me know.
Good luck.

You guys would be shocked at how many cars dealerships get with minor paint damage from the factory. Take a close look at how a car is loaded onto a carrier. Thats where most of the damage happens.
Our body shop gets "a few" refinishes per week from local dealerships. Talk about mastering the art of blending, you've got to have good painting techniques.

I just picked up a SE last Monday. It was at night and they asked me to sign a piece of paper that said I accpeted the car as is, and there was no damage noted.
I called a family member who is in the biz. He said to put on the form "STI".
That means subject to inspection. The dealer also gave me a form that said "OWED" to customer, they wrote on there I had yet to inpect the car.
The very next day, I puposely washed it. Best way to go over everything. SUre enough, I noticed the gas door had dents in it, very sublte, something you can't see at night. THere is also slight damage to the paint on the fender. Appaerntly the door must have been stuck and the idiot that tried to fix it was banging the door with his hand and there were tool marks as well.
They are fixing it for me but I don't know how.
Then this past Saturday, I'm just getting to the 200 mile mark or so, and I notice that the rotors are starting to warp. I also notice the 6 speed has a nasty whine in 2nd gear on decel. My $20k Talon with 130k miles on it drives better than a brand new $30k max. I'm really ****ed about the whole thing and I'm also looking into returning the car although it may be too late, it's been a week.

back in 99 when I picked up my 2k, I noticed scatches.. it was at dusk so I really didnt see the extent of it. They said the scratches would buff out, turns they were UNDER the clear. There was no record of it by Nissan, which means it happened before even being transported.
I was offered $400 to repaint the front. I didnt want a brand new repainted car, plus no shop would paint the car *correctly* for what Nissan would pay. Figures. I took some service credits.
Its something I only see when I wax it and I'm really close. So it wasnt worth getting a crappy paint job.
The upside is that the front that was obviously recleared has very few chips. In the long run, the extra touchup was stronger than the normal paint. Still really bothered me.

Get used to it bud, i quit complaining about it..
I have 29,000 kms now since May 2002, and i have all the same problems as you including my 6 speed and the rotor warpage..
I ensure you will get used to it but it is just a sign that Nissan really don't give a %hit..

It makes sense from a $$ standpoint, Nissan is saving about $150 per car by using the inferior rotors from what I can tell (stock v. $$$ for decent aftermarket). That saves them about $18,000,000 per year, yep, 18 million. It's worth 18 mil to put up with the service and warranty work.
