got caught street racing need legal advice

well here goes its 12:51 am middle of no where me and my friend lost the line of cars we've been lookin for them for 2 hours no luck so we pull up to a light and both go at it. we take it to 65 in a 45 and i see him slam the brakes and hit a side street we both bail into the parking lot im thinking wtf is going on? then i see red light in my mirror my heart drops. now i knew why my friend bailed out so fast f**k im a idiot i lead the cop right to him. there was 2 chp guys in the car one goes up to me the other to my friend. the cop was driving on the other side of the street didnt hear us peel out just heard are intakes. neways i gave him all info i JUST turned 17 i had 1 speeding ticket before, he gave me a ticket for 3 voilations; 1 is speed contest, 1 is i dont suppose to be drivin past 12am (provesional license) the other one i have no clue. he tells me to pop open my hood i start the engine he was a idoit(i had cai y pipe muffler my car was soloud he thought it was a exhast tip) so no fix it tickets=] so what kind of fine am i looking at i was going 65 in a 45. there was no cars on the road, the road is so smooth well lit. how much is speed contest ticket? should i get a lawyer ? need help i dont want my license suspended. any advice would be appreciated thx. ps worst night of my life it hasent kicked in yet but when it does gonna have a breakdown *uck parents gonna kill me. i dont even wanna think about the insurance.

Man I'm in your same situation......

got caught racing at 4am a few months ago and I just got my court case notice where I plan to plead guilty in a hope for leniency. I'm already scheduled to take a driver improvement class this month which was scheduled by the courts, so that will help me out a little on 3/15/01 when I face the judge, but I'm a point or two from a 30 day suspension so lately I'm being very careful and will remain to be! If anything ADMIT guilt since you were indeed guilty, I doubt a lawyer can get you outta this one, but that just my opinion. Since you're on provisional I doubt you can avoid the charges anyways, truat me your in for a rough ride, since, <b>1)you're on provisional 2)you were racing 3)you have another ticket before 4)you were speeding (15+ is usually 2 points, at least in MD)</b>, it'll be tough, but you can get a lawyer if you want, but he better be one hell of a lawyer!!!! good luck my man, I know it sucks, but its not the end of the world, lets us know how it works out!!

well I don't think the 65 in 45

matters that much because it doesna't sound like he had a radar gun up, so they can't get you with that. You don't spend the money on a lawyer for this. Say the cop must have heard your loud intake/muffler and got the impression you were racing when in fact you weren't. IF the cop did get you on radar, in court ask to see the papers for when the radar gun was last calebrated. If they can't present those then you get off free because the gun could have been wrong. Also, never just pay the ticket because if you go, and the cop doesn't show up you plead innocent and automatically win! If your parents will help you lie, say that you were out going to a drug store to pick up some medicine for your sick mother or something, and maybe she'll testify to that for you. Thats about all I cna think of, good luck

i got a 55 in a 35. 20mph over.. which is same as yours, $190 ticket and 4 points for me

I would say, yes you can argue some legalities of the proof, did he get you on radar, calibration, all, but I think the only one I'd go with is the "was it on radar". "yes, your honor, my friend and I were goofing but I don't think it was anywhere near 65 and since my car has louder than normal intakes, I'm sure the noise drew attention...." Heck, I dont' know, but as the other post 65 in a 45 doesn't sound that bad but the judge will be looking for remorse, accountability and the knowledge that what you did could get you killed. Just remember, that's his job, he wants to keep you and others on the road alive!!

Dress nicely (makes a HUGE difference I promise), nice slacks, dress shirt and tie would work (visit a local thrift store if you don't have any), get a haircut, short one but not extreme, be respectful(yes sir, no sir, thank you your honor and to all in the courts not just the judge), quiet and sincere. Best of luck to you and just count it as a lesson well learned.

PS. I hope you don't ask your parents to lie for you and I hope they wouldn't even if you asked in the first place. Its a traffic violation, don't beat yourself up about it, learn from it, and tell your parents, and use the same mannerisms with them as you would the judge, be sorry, let them see that, lose ANY and ALL arrogrance/attitude as for your driving skills AND blame. There is NOTHING that pisses me off more from my 16 year old than that attitude! Don't have one and I bet half your battle with your parents will be none existent.

GOOD LORD! Tell the court he was simply going to get his poor, sick mother some medicine? I don't think that worked back in the *horse and buggy* days. Hmmm, instead, maybe:

Threaten the court with violence. (Tried and true...!)
Commit suicide before your court date. (That'll fix 'em.)
Claim temporary insanity. (Wet yourself. Foam at the mouth.)
Flee the country, and take your car with you, Sundance!
Throw yourself at the judge's feet and beg for mercy. (Not out in the courthouse parking lot, dummy. In the courtroom!)

Anything... just don't be a MORON. Judges hear testimony from MORONS everyday. They can spot a MORON a mile away. They get tired of dealing with MORONS after a while. If the judge detects moronic behavior in you, like telling him a dumb, bullsh*t story about getting medicine for your poor, sick mother, it'll be: "Off with your head!"

You screwed up. Now it's time to pay the piper. Maybe. Only a qualified attorney can advise you well. Not us schmucks here on the forum. Good luck to you.

im pretty sure he got us on radar he was traveling on the opposite side of the street. im just worried about the speed contest part.

The only thing you can do about that IMHO is just mention how he remarked on your car's sound, and that he must have thought that since you have a loud car you were racing... and how you'd never do anything of the sort.

$20 bucks on the "speed contest" getting dropped IF you display appropriate dress and manner showing utmost respect for the courts, act maturely, quietly and responsibly shocked at the "racing" aspect and if you cross your fingers. :-)

I live in WA and my friend got a wreckless driving ticket for racing and he told me you are NOT supposed to admit to being guilty, I don't know why but it had something to do with the fact that if you say you are guilty, you pretty much lose the right to fight for you case.
I don't know about you guys but stepping on the gas nicely to 45 mph makes the intake howl a nice bit. You could say that you took it up to 45 mph and let go of the gas (if he says he got you on radar doing 65)

let the lawyer do all the talking....

speeding: in cali 20 over the limit is the borderline of getting traffic school. its up to the judge

out pass 12am: cant do nothing their..community service..or pay fine

ur last ticket: could be to see a ref. which means u gotta take ur car to get checked out. are ur mods legal, where u live? if not..take'em out...just in case..im not sure on this one..

just get a lawyer..whats a judge gonna think?..sees ur ticket, sees ur age, sees ur a guy, sees u drive a better car then him...lol..

some judges can be cool though...others can be str8 ********s.......

Legal Opinion

I am an attorney but not licensed in CA. Here;s what I do for my clients. I immediately file a motion or a jury trial and begin with my discovery requests. Get all the info you can. This will require you to do a little legal research. Go to Lawworld.com and browse your state statutes for help with rules of the road along with cival procedure rules in CA (they usually follow federal rules). You only have a limited time period after you receive a ticket to ask for a jury trial. If your state doesn't allow for a jury trial...Call the prosecutor and explain taht you will pay an equal amount of money (or up to 50% more) if he will let you plead to a non-moving violation. I usually have my clients plead to a muffler violation and pay the sam,e fine as their speding ticket. This allows for 0 points on their record. Lastly, never plead guilty-plead "no contest" if you want the easy way out. Good luck.

Yea, Thats basically what i was trying to say...Just never plead guilty! Why not at least TRY to get ur butt out of it? The radar calibration thing works, often hey don't dbring the papers with them. Also, resceduling the date can make it more likely that the cop won't show up for it. The non-moving violation bargain sound REALLY good, i've never heard of that. Also, like I said, story with loud muffler/intake make it seem that you race is good. Bullseye, are u trying to call me a moron? You do what you wnat with ut ticket, I gave my advise which he asked for OPINIONS. And why did you let the cop look under your hood? Doesn't sound like he had reseanable cause to me, next time say you wnat to maintain your 4th amendment right to unreasonable searches and seizures. GOOD LUCK!

i appreciate it gonna call a lawyer and figure how to break the news to parents ill be ground for at least 6 months if im lucky, probally take my baby away from me too =[

No, I'm not trying to call you a moron. I just don't think lying in court is a good idea. And asking your folks to lie in court for you is *really* not a good idea. And the lie you suggested probably won't ring true in a judge's ear. I think you have a heart of gold, but that suggestion ain't gonna win no beauty contest, OK? Peace.

I know this one's a little old, but wanted to throw my $0.02 in. I went through the same thing when I was in college 10+ years ago. I was in my 280zx, it was 11:45pm and I was heading home. Some guy pulled up at a light and we got on it. I backed out at 60 (in a 45) and he kept getting it and took off. Next thing I know, a cop is coming up fast and sees me first so I get the ticket.

Lessons learned:
1. Get a lawyer. There are rules and regulations in the traffic code that you do not understand and he (or she, hey whatever) does. They also understand how to work the system as far as other plea-arrangements with the D.A., judge, etc.

2. Tell your parents. Believe it or not, they probably know some people (or an attorney) who would be willing to help. If nothing else, they'll appreciate the fact that you told them (it may be 20 years from now, but they'll appreciate it...).

3. It's not the end of the world. In my state at the time, a racing conviction meant they could take your car from you (the court, not mom & dad!). Whatever the outcome, learn from it and be smarter in the future.

4. Racing is for the track. If not for yourself, do it for my 2 year old who may be riding her tricycle on that street where you're doing 65 instead of 35 or 45...

Peace and good luck, my friend. You'll get through it. It sucks for a while (like, until it's over). But it will pass at some point...

yikes

told parents grounded for 6 months, i at least get to drive to school and back. yea this ticket is stressin me i got so many different opions form friends and u guys. 1 says get a lawyer another says plead guilty another says pray the cop dont show up. im at a lost for words. if my insurance rate goses up because of this, my parents says they will make me park my car. so this is the other big question, my car register to dad i drive on his full coverage insurance the insurance company (geico) has no idea i drive this car. will they find out?? if so what happens ? 17 year old kid 97 nissan maxima o dont like the sound of it. i just want this to end omg waiting is the most streesful part. ive been feeling like **** cant concentrate in school geez i think this feels worse than murder. daym gottta go any advice would be appreciated about the insurance thing.
