auto tranny stuck in 3rd

i am very perplexed...guess what? nissan says that they cant dup the problem...here we go again. this is the 4th time i have had it in for this. now it is so bad, i have to drive 3-4 blocks starting out in 3rd with the selector in 1st before the tranny figures out that it really should be in 1st! its like putting your foot on the gas and brake at the same time...the car struggles to go, then once the car reaches 15mph or so, it will shift into first?!!? wierd. no ses light, and it only does it when the car is cold...not like 30*F cold, just not warmed up. it does it in reverse too. i also get a really slipping shift comming out of 1st once it kicks down and goes to 2nd. not 3rd, just into 2nd. could this be a vb recallibration issue? i have not done this yet. i am having the fluid flushed and changed today. the car only has 37043 miles! already an exhaust, window switches, seat motor, and coil packs! nissan is losing my loyalty! any ideas on the tranny would be appreciated.

this is not something that i am trying to do, the tranny just doesn't seem to start out in 1st gear like it should again the selector is in 1st gear, but the car takes off like it is in 3rd.
