Yet another Maxima gets f-ed up!
My wife and I were hit last night in her 2000 SE. It is fixable, but she was hurt fairly badly.
I am okay; her neck is pretty sore tonight.
Long story short- We were waiting to make a left-hand turn off of a secondary road into a subdivision. We were rear-ended @ 40 MPH by a pair of 17-year old girls. The driver has no license (or insurance), and she was not supposed to be driving the car. The car was owned by her father, but was uninsured because it was supposed to be for her after she got her license. Additionally, it was driven with expired tags- and those tags were not even issued for that vehicle.
It was a disaster. Damage is around $4500. So far she is out of work for one week, I have missed 1 day of work, and we are moving Friday. We are not packed up yet, so I am not sure how things will get packed unless I take off more work, because she is too sore and hurting to pack.
We have already had 1 ambulance ride, 2 ER visits, a S-pile of X-Rays, and 4 prescriptions. What a pain in the ****.

That really blows chuncks. Hope she feels better, and what's your plan on dealing with the guilty party(s)? What a time for too, during a move. Might wish now you were in your truck, maybe, maybe not, but be glad because as always sta.ted and hardly ever realzied, "it coulda been worse".
Damm, Sorry to hear that. I hope they got some assets you can sue for. Well the main thing is the both of you guys were not hurt very badly. Sore bone and muscles will heal, and the car is only property and can be repalced or repaird.But you gotta sue or be screwed for the damages. Good luck

Well as far as I know the father is responsible for the conduct of his daughter at age 17. I would go after the old man for the vehicle damages and see what the insurance company will do for the personal injuries and as far as they are concerned I would recommend that the victims don't sign anything at this time. In fact, it may be in their best interests to talk to an ambulance chaser.

You can also contact the District Attorney's office because this is a potentially serious crime and they will act for the preservation best interest of the public.
I hope you got a Police Report. And you should have uninsured motorist coverage if you are fully insured. I think $10,000 is mandatory in NY. Yours might be more or less.
In short, this is definitely an actionable lawsuit. The parents are liable without a question. If they own a home or a vehicle you can actually put a lien on them and garnish wages if they are employed. I think the statute of limitations is 90 days so act fast.

Long story short- I have uninsured motorist coverage, but my insurance company has tried to minimize their exposure as a first-party agency. That is about to change.
See, the accident happened in WV, as we move from VA. WV law is pretty stilted toward the party not at fault. If I pursue the situation as an uninsured motorist claim, then my insurance company effectively becomes the "insurance" for the uninsured, and I can recover from my own agency just as if it was the agency for the vehicle owner. THey can then subrogate the vehicle owner, or his insurance company (more on that in a second). If he bought the car WITH a lein, he MUST have liability coverage to secure the lein. He may just be lying to the cops about coverage. If he bought it in cash, then his CURRENT policy (one on his other vehicles) will automatically be in effect for 30 days on the new vehicle. THis is as a "courtesy" to customers. The trick in that is forcing the existing policy underwriters to cover this claim.
Because his daughter was the driver of the vehicle, it is difficult for the insurance company to claim that the vehicle was stolen, so this is not as grim as it looks.
On top of all of this, his insurance company will have to fight claims on 2 fronts- one from my insurance company for subrogation, the other from my father and myself. I went to law school in WV (though I do not practice now), and my father is an attorney in WV who specializes in insurance claim mediation. I do NOT envy the insurance companies.
I also have the option of a personal injury claim for negligence against the vehicle owner. I hope to not have to exercise this option.

when i was hit by an uninsured driver, my insurance company took care of me and then went after the driver. I think it came to a point where the other driver wasn't responding to my insurance so I got a call saying that they're takin the case to the DA and that we should be ready to give any information if we were to a receive a call from the DA.

Ive had a couple of wrecks in my Max, well one on my previous car, which was totaled and one less serious in my current Max. Anyway, im suprised at how well these cars hold up and they really calmed my mothers fears (
) about driving. Im glad youre both okay, for the most part at least. Wrecks are scary, and it makes it so much worse when the other person at fault has not enough responsability to have insurance. My last wreck was with a guy who had no insurance. My insurance company, which is Geico (

You're a better man than I for not filing a civil suit. I'm not out for a quick buck but, perhaps the experience would teach the parents and child a valuable and expensive lesson. I'm glad you and your wife are okay besides the soreness and general inconvenience. Do you plan on getting the Max repaired?

Im glad everything isnt worse than what it was. Sorry to hear about your wife. I hope you get these teens, and I hope they realize what you are Not doing to them that you could do so they will learn it couldve gone far worse. I wouldve gone all the way, taught them all a lesson. Sometimes you gotta be calm and do things a different route. Good luck and I hope things get better for the wifey.
