Help with #!%@%^ tranny

Hey guys,

A while back i had my entire transmission replaced (under warranty thank god). Me thinks it was approx. March of '04. Well i just went to a dealership to get the oil changed/etc and the mechanic tells me "There's something really wrong with your tranny". He then takes me out for a ride in my own car and shows me what he means. Once second gear hits, the car seems to hit a brick wall. A 2-3 shift is fine, but second gear seems like it just dies.

Now here's my issue. Nissan only warranties their work for 12months/10k miles. Am i SOL? I mean, jesus, they obviously didn't fix the problem the first time. What do you all think?

First you have to make sure it's your transmission ...

Well the tech's at the other dealership flat out said it was the transmission. To the point that they wanted to take $2k off my trade in value because of it.

Just because they said doesn't mean they're right though. Get a 2nd opinion.

Has the original warranty that you got the transmission replaced under now expired? I understand that more than 12 months has elapsed since the transmission was replaced, but isn't the drive train warrantied for 5 or 6 years? Its certainly more than 3 or they wouldn't have replaced the tranny last year.

Why are you going to the stealership for oil changes and routine maintenanace on a 2000 Maxima? Avoid them like the plague.

I had the car at the dealership once for the TSB on the tranny slipping (Was shifting into second REALLY hard) and they told me nothing was wrong. About a month after that the tranny totally died. The car at that time had 58k miles on it. This was March '04 if i remember correctly. So the car is well out of its powertrain warranty (5yr/60k miles) and is now over 12 months out from the date the tranny was replaced. I'm thinking maybe Lemon law?

Lemon law has nothing to do with this situation. What I don't understand is you didn't notice this before the mechanic did? Sounds like something you would've noticed way before you took the car in for that routine maintenance.

That's what I'm wondering. How did the problem magically appear after you'd taken it to the stealership for a maintenance check? It sounds fairly suspicious.

Were you thinking of getting a new car? Do you think they could be making up a story just to cheat you ut of that $2000?

Did you notice any change in transmission performance before the dealer technicians volunteered this information to you?
