Someone stole pics of my car once again and put it on there site to sell body kit parts.
I emailed the website to remove them and they said NO.
Here is the email response I got:

The only way you can give copyright to picture is by tagging them with a embed watermark by a digimark program. This cost approx $10 000 per year to get the digimark software and we scan each picture before putting them on the website, your pictures doenst have this watermark. We are not talking about layers OVER the pictures but watermark encrypted INSIDE the pictures, in the code.
You should also know that pictures on cardomain or any other public website are used for general public and they are free to be used by anyone at anytime for business purpose or personal purpose.
You should know, at first, that if you don't want the people or company to use your pictures, well simply don't show them to general public and keep them for yourself.
You should know also that there is a way to ask something and there is a way to earn something. If we get a polite email that ask us gently to remove pictures, we would do it within 5 minutes.. but the way you asked for it.. I will be more than happy to keep them on the website.

They would probably be exploited if it was me. Pizza would be ordered for 100 people every two weeks, and the other two weeks, there would be an exterminator from a different company everytime paying them a visit. They just wouldn't know where it came from, and possibly have to foot the bill for it.

Just so you know the Maxima community is a tight knit group and we are on to you scrubbing pictures of their cars and posting them on your website. You ARE building up quite a bad reputation through out the Maxima community. If you use someone's picture and dont give credit, or ask then expect them to be mad. I would be too. Its probably not worth involving a lawyer. There is a border in between us. Good luck getting this guy to come to a US Court over a picture. Everyone should just send the webmaster emails. After he gets 10,000 or so maybe they will change the way they do things.

That may be true for canadian law,(I have no idea) but Im pretty sure that all media does not have to have a copyright written on the picture, as long as you can prove the picture is yours,(originals, negatives, scans, etc) the picture is automatically copyrighted and protected as yours.

latinmax: look up the us copyright office online and copy the appropriate bits of law into an email and send it to this moron. if he still refuses to remove your pictures... well, i'd let it go... but you have to take this step if you want to be taken seriously.

Your company is now being derided and trashed on Maxima.org (the largest online Maxima site) and MaximaRacing.net - as well as a few others. I'm willing to bet that you will never get any orders again from the 51,000 members of Maxima.org.

by the way, you might be interested to know that ALL worldwide domain names are controlled by the United States of America....therefore worlwide domains IIRC can be regulated by a US-based agency (under US law, I believe).

First of all, you should verify the civil code in your area and see what the law says, if they state that the pics on a website is the property of the website owner than he stole the pics and there is no law in canada that authorise anyone to steale, end of story. Instead of getting nervous and frustrated, you should read instead of trying to threat others. I've just check on their website and they claim that all the pics belong to them, so you see that it doesn't make sense at all, he steale an image and then claim it's his, if that reasoning would be thrue, man I would start stealing Picasson and what else. Canada is very big on privacy laws so I don't know if I believe the whole statement about using other people's pictures.

I know we all hear this crap but I'll emphaize it again... make your complaint very clear and straight to the point. Point out facts, cite law if you have to. Be professional but be blunt. And tell them what you want done (pictures removed, shutdown, etc.).

By the way this is not the only site I have put this up on (just the only one I sent you the link to) and the response is just as bad for you.

That is not a "life lesson" that is yours for the teaching. I would be pissed as well if my car were pictured somewhere that I did not know about and someone else had acted like it was their "property." It's great that you didn't do it intentionally, but this is something that you have no right to keep up on your site. If you have a problem with people getting pissed off since their cars are pictured on your site, you should contact your vendor, as we will probably be doing as well. This is NOT a situation where you have the right to keep the picture and he has to "ask nicely." You are legally obligated to remove the picture from your site, no matter how you got it. I suggest you do it next time and drop YOUR attitude--yours is no better than his, AND you are legally in the wrong.
