Hit and Run - my baby is dead....

as some of you probably know, i just bought a 96 GLE about three weeks ago. well friday morning, on my way to work, a chevy 3500c flatbed ran a light to do an illegal UTurn and destroyed my car. i hadnt even put 1000 miles on her.

unphased by the collision, he drove away. luckily a driver behind me followed him and got the plates and company name from the side of the truck. a police report was filed and the company was contacted. they claimed that the truck was driven by a contracted company, and it was not their responsibility. however later in the day the owner of the truck, not the driver, called me and gave me his insurance policy information. things are in motion.

im broke now, having spent all my money on this car in early august. so potentially i could get screwed on all this. i didnt have collision or comprehensive on my insurance policy, so basically i gotta get it from his or take a 5k loss.

just a sympathy thread.
wisdom taken from this experience: between all the old people and illegal immigrants in the state of florida, YOU BETTER BUY COLLISION AND COMPREHENSIVE ON YOUR POLICIES. saving 100 bux a month is nothing compaired to a 5k loss.

im hiring a lawyer tomorrow.

That sux *** man. Sorry to see what happened. I think I'll have to agree on that coverage stuff.
My boy got hit the other day too by a jeep. He was drivin something other than his Maxima. Everything was covered including the extras that he kept receipts for on his car. So he's gettin a sum pretty soon. ALL these MODS you guys are doin, I know Ya'll got them receipts. Also if everything is stolen out of the wrecked car, you can get that back in reimbursement as well. Right? Get some of that money back. Right? It sound sensible, but I dont really know about full insurance on a 1995 Maxima. How much could I really get??

That was a nice car. That's to bad. In Florida the owner of the vehicle is responsible, no matter who is driving. Don't let his insurance co. push you around. If you payed 5k for the car 3 wks ago, you should get a check for 5k plus anything else you put into it (i.e. wheel, tires, tune up, etc. ). Good luck.

Dam this is a shame I just read your post regarding installing the ks sensor and now this, get all the money you can get. you can keep the car and fix her up. all you would probably need radiator support, radiator, hood, bumper, headlights they are not expensive. go to a body shop see how much it will cost to fix. Sorry for your loss, but hey at least your alright that's what really matters

oh man, thats sucks BAD! even more so because i know you just got it and were working hard to get it right. you shouldn't have a problem getting payed. don't forget reciepts on all the stuff you did. btw, thats a horrible title.

the car is totalled....
on top of probable frame damage, tranny fluid and coolant were SPRAYING out of the front of the car right after the collision. airbags deployed, whole interior is covered in that **** now.
blue book and nada for this thing is like 4300-4800. costs of repair obviously exceed that.

Buy it back, take the check and use it towards parts, a welder, a few cases of beer, and then use the $2k left over on some goodies!

1-800-423-1003, that's the number to a junkyard in florida that has a white front clip listed on car-part.com, no price listed but you could probably get everything including the core support for under a grand, welding the core support is not that bad, there's nothing to worry about in terms of 'lining up'. I had very similiar damage and repaired it, yet to get it painted as you can see in my sig.

Hey man, where in FL is that? looks like WPB or something further south than me.

Anyhow, That sucks dude. . The lawyer is a good idea. My uncle was in a crash when a lady ran a red light, flipped his F150 2 times I think. He had to have surgery on his neck and stuff...definitely not cool. I'm glad you're ok though, good luck with everything.

sucks the car is totalled. if you have a place to put the car, you should buy it back from the insurance company and then part it out if you can get it from them cheaply.

Honestly i wouldnt bother fixing it unless you dont mind driving a car you know was raped. When i got a dent in my car i almost sold it because i dont like driving a car i know was violated. Plus the damage will really reduce the value of the car if you ever go to sell it, they can simply carfax it and find out. Get a lawyer, sue the guy who was driving it for a hit and run, claim neck injuries, go to a doctor(one who knows you well) and get notes on neck injuries. Then get the money from the insurance company, in total you will easily get enough for a slightly used nicer car. Like an 04 maxima or something else you like.

The fact it was a hit and run makes things more interesting and you have more leverage. And fyi, a hit and run in any sense, be it with a car or person, is a felony. So any lawyer would tell you to just rack up the charges against him.

That's absolutely right. I wouldn't settle for a penny less. The insurance company will come back to you with an "offer". They will say that is all they can pay, but that is really an "offer". Don't accept it unless your happy with it. 9 times out of 10 they will budge if it means going to court over it. Especially here when it's not like a $30,000 car.

Also, just like that last few posts, claim injuries as well. The sky's the limit. I'm an insurance professional, this is the best advice you can get. Also, don't forget that lawyers take a HUGE cut of what you get, so I would think about that. Try settling on your own first, then at last resort go for the lawyer.

Last I checked maxima's didn't have a frame, there uni-body construction. likely the only part of the unibody that got damaged was the radiator core support, not a big deal at all, I've replaced several. a rotted or bent core support(s) doesn't make a car garbage, the 4-wheel alignment will still be spot on, it's the price of labor and parts like airbags, paint, an entire front clip, etc that makes the 'total' cost to repair at a licensed body shop exceed the value of the car. But why part it out? Sell it for $1000 on craigslist, you'll get the same if not more money than parting it out, with much less hassle.

well time is of the essence here. this happened on friday morning and ive waiting several days to even get into the legal issues (i was taking care of my neck and knee). im basically all alone in this state, i got no family to go to bat for me, no one to recommend a lawyer. to boot, im broke - all the money i had was put into this car a month ago. i went to a chiropractor on friday and then the ER on saturday morning ($1300) and bsically all they said was that i had whiplash. they did an xray even though i told them nothing was broken. so i finally retained a lawyer this afternoon and i just have to wait for progressive to get their **** together. the property damage and the personal injury are seperate issues. the car itself (and the towing fees, etc) are all covered by progressive if they find the driver of the policy holders vehicle to be at fault, but as far as the injury goes, i only get money if it turns out i need physical therapy on my neck and back as a result of these injuries. so in 6 months (florida law), after therapy three times a week, if i still feel the same, then i can file a suit. but if im better or whatever, then all the money spent at the ER and doctors this weekend is a loss. so you can subtract that from the already lowball figure they are going to offer for the car (nada is 3875, 4875 and 5800, blue book is 3900 4200 and 4500 roughly). so basically, a hit and run felony by an illegal immigrant on a hard working, law abiding american is going to end up costing the VICTIM money. so totally ****ed

its not gonna be as bad as you think. progressive is actually a decent company to get hit by. they have to reimburse you for any physical therapy your dr. says you need, until they say you don't need it anymore. you'll get some pain and suffering if you go. the chiropractor should wave costs until you settle. you'll get the value of the car plus all that stuff you just did. thats how it goes in tx anyway. keep your head up.

You wouldint have you pay for the dr visits the insurance company takes care of that. From my experience your bodily injury theropy has nothing to do with being sattled by the insurance company. Meaning you could be at the dr for 6 month and then you will after about another 6 - 8 month you will get you settlement well at least this is how it is here. O and the very first check they will send you it propery damage fees. Then comes the lawyer with your medical history after the accident. My advice go to the dr tell them you cant sleep at night tell them what ever hurts . And keep going for all of the 6 month.

When I was rear ended, I recieved 12 visits to my chiropractor of choice. The only reason why it was 12 visits was because I had been going to a chiro for 3 months prior, and he told me that I was in the same state if not better than I was before the accident. Their insurance company will cover you....especially considering that you are not at any fault. Keep fighting, and you will win. Sorry to hear of the loss btw.

jeah, good luck. My dad was rear-ended by some hick a while back. He went physical therapy for a bit, and received a nice check for P&S.
