Hit and Run - my baby is dead....
i hired a lawyer. the driver of the vehicle is still no where to be found but i have the owners information. he is dodging the police to delay filing the report, but he did produce the truck and show the damage to the investigating officer. progressive, his insurance company, has accepted liability and they will be making me an offer within a couple of days. i have standard "whiplash" with cervical muscle strain. according to doctors, i need physical therapy three times a week for three months in order to see if there is permanant damage. a personal injury lawsuit has been filed already. the most i could potentially win is 3500 dollars if there is no permanent damage (ruptured disc, nerve damage, etc). i know they will lowball me on the car, so im expecting like 3500 from that as well. im still losing money, but not as much as i could have.
UPDATE: 10-18-07
ok ive been posting about it in other threads but here you are.
the OWNER of the truck was insured through progressive, and because of the good samaritan behind me who sped up to get the plate info after the truck peeled out of the intersection, i was able to file a claim through them. within about 8 days i had a check for the NADA value of the vehicle (a 1996 GLE with 141k, sunroof, leather, excellent condition) which was $4875. They then gave me 4% on top for taxes that i had to pay at the DMV, so the check was for $5191. I originally paid $3750 i think, so this was a gift.
the driver of the vehicle still has not been found. now the owner, and also the owner of the company that employed him, claims that he hasnt seen or heard from the driver in weeks. the passanger from the truck, however, came forward for some reason. although he says he didnt remember anything from that morning, even though the moron was sitting on the side of the truck that i hit.
oh yea, get this guys name. hes a spanish immigrant, mexican i think, who BARELY speaks english and his name is Walter Randall. hahahahaah. just about the most Irish whiteboy name you could imagine. i wonder whos identity he theived.
i just wanna say how quick and nice PROGRESSIVE INSURANCE was to work with. they gave me 24 hour contacts, called to help me find a new car, ran two CARFAX reports and so on. my insurance company, GEICO, was unbelievably unhelpful. i called them 5 minutes after the accident and asked what to do. they said we have no suggestions for you because you didnt pay for comprehensive or collision. i asked if they could at least RECOMMEND a place to keep my car until the adjusters can look at it. they said no.
I plan to switch carriers in a week, with my next paycheck.
anyway so i have "cervical contusions" (the top of my neck) according to my trip to the ER the following day. i have to go to physical therapy three times a week now, electro-stimulation followed by a massage. the neck, to this day, is still pretty stiff and once in a while ill turn it the wrong way and get a sharp pain. ive heard stories about peopel having pain for years after an accident like this.
so my mom rented me a car for two weeks to drive around and look at used cars in the area. i drove probably 700 miles and spent well over $100 on gas driving around in a 50 mile radius. i spent almost every day in that two weeks looking at maximas. after those 14 days i had found two (out of like 30) that i was considering. one was a black/black 97 SE with 120k, leather, sunroof, perfect condition with the 01 SE alloys - but the dude wanted 6k. i offered him 5 he said no. the other was a northern beater with 110k, a white 96 GLE. had paint problems and two blown o2 sensors. that was $3100.
so i was about to give up and the LAST NIGHT of my rental, an ad comes on craigslist at like 11pm for a 97 GLE with 41,800 miles for 5k. i thought it was too good to be true. i left work early the next day, with cash in hand, to get a jump on it. well it was dirty and had some scratches, but the thing was in perfect mechanical condition. brand new sumitomo tires, in tact leather, sunroof, all service work done at the dealership. one owner - owned for 10 years by a 91 year old woman who drove it to church and the grocery store. carfax checked out so i ended up giving the guy $4500. it was a steal. ill have pics up in a little while.
ive spent close to 6 hours cleaning it so far, and i still got some to go, but it was a great buy. idles perfectly, shifts smoothly. i lucked out. not to mention the NADA value is like 8275. worst case scenario, some illegal ruins my car and speeds off again, immona get even more money.
