Question about ethics from engine sellers...

Hello,

You remember my issue with a 98 I30 engine I put in my car about 2 weeks ago, well the engine runs but it has a massive oil leak and a couple other leaks as well.

Basically, let me run down the history with this new engine and myself.

1. my engine blew in my Maxima due to my carelessness.
2. I bought a 98 I30 engine with 72000 miles for 500.00
3. Had the engine installed by a mechanic...
4. Started driving the car, noticed car losing power at times, shutting off at times and white smoke coming from the hood.
5. Had it checked out by a couple local friends, they told me it has a oil leak and since no white smoke is coming out the tailpipe then the problem is a external one, meaning the engine is running well...
6. Went back to the place I bought it at, was told by their local mechanic that the "Rear Main Seal" is leaking....
7. Took it back to my mechanic, was told by him that he fixed the Real Main Seal and if he pulls the tranny again and realizes it's not the RMS then someone has to pay him for his time and labor.
8. I give him the number to the junkyard I bought it at, they tell him they aren't responsible, their only concern is to make sure the engine runs... (they claim to not cover electrical issues)
9. He tells them he'll get his little camera and take a picture of all the stuff wrong with the engine, he tells them they are liars, every engine they get should be tested... they can't sell people junk motors and they must pay.
10. Conversation ends, junkyard stands by what they say.

11. He calls me today, tells me engine leak IS NOT COMING FROM REAL MAIN SEAL and tells me to call them and ask them how they want to handle it (who's paying the mechanic?)

12. I call them, they offer me $250 bucks back (I bought the engine for $500), they tell me DON'T tell the mechanic due to the fact that many of them lie and will up the price blah, blah, blah.....

13. I told the shop to send someone down to the mechanic shop and look at the engine, (mechanic told me to send one of them down there so they can see what the problem is).

I have a 30 warranty, warranty is still good, how should I handle this? By what you read, who's right? and is the junkyard held responsible?

IMO ur mechanic is correct, he needs to get paid and the junkyard involved him by implying that the work he did was not done correctly -> in order to get out of liability. Don't take their money until u find out exactly what is wrong with the motor, if you take it and then decide to take them to court it'll look like a settlement was made prior to suing and you'll loose the case. Check ur valve covers for leakage, oil mayb reaching the exhaust and burning there. Have your mechanic do a comp check or leakdown test and a visual inspection-->good luck

I think before you can say who is responsible, you need to know what the problem is.
# 11, Your mechanic said it's not the rear main. So what did he say it is?
None the less, the salvage yard is telling you the norm. It's a used engine. It runs. It has no internal problems. They didn't sell you electronics, just an engine. It's your responsibility to change everything over and use a complete install kit, including all new seals. Sounds like a seal didnt get replaced or one got pinched. Only one way to find out. Probably not the answer your looking for.

The oil leak has been fixed to day by the mechanic, but I have another problem and the problem is that the engine doesn't get enough gas and it shuts down on me at every light. Either the injectors are dirty or something but the car struggles and stalls on me quite often.

I didn't pick up the check yet from the salvage yard but I'm going to talk to them in the morning about this. I will ask them to fix it since it has to do with the engine, if they decline, I might just ask for a full refund and get back into payments. I've had a couple issues already with this engine and I need to get them resolved. The junkyard should have testen the engine somewhat but to sell a engine with massive oil leaks and big time fuel problems isn't good, if they don't send their mechanic to my house to fix it I'll get the full refund.

A junkyard generally doesn't have mechanics on hand, just parts pullers, unless they also have a shop. Chances are even then they won't 'send a mechanic to your house', that's rather unreasonable, at best they'd have you bring your car to their shop, if they have one.

Many of the cars most junkyards bring in are totalled or otherwise damaged to the point where the vehicle won't run, even if by chance they have the keys for it. No real way to test it in that scenario.
