CHASE AUTO FINANCE-Youve got to be kidding.

Im so hot right now I dont know where to begin exactly.

I own a 2003 Nissan Maxima. 5.5 gen. Love the car to death. alot of work into it, been a pleasure to drive, pretty reliable. Prior to deployment I financed with Chase, kind of got a high percentage rate ~7%. My intent was to refinance wtih my credit union, of course I deployed prior to doing so. And kind of just let it go making the monthly, and saving money on the side.
Never been late on a payment for the life of the loan. On the tenth of February i called for my payoff balance. Forwarded a money order to them in the total amount owed. Updates on the account were done over the phone, was given a ten day payoff. Cool. Only thing i want to hear from Chase is thank you for banking with us, heres your title.

2/17 I receive an automated call. I call in to speak with customer service, and am rudely informed that "As your account is past due you will have to speak with collections, WE dont handle late accounts". Im pissed because the delivery confirmation was signed on the 15th that it was received. You receive a money order, and your an auto finance instituion, then it should be posted to the account??? Maybe???

NO.

Im informed that they have received no such payment, and that I need to cancel the cashiers check immediately and remit payment again. Needless to say I called my credit union flipped out, and nicely enough the branch manager cancelled the cashiers check, reissued another and actually took the liberty at their cost of Fedex'ing the cashiers check to them again.

Needless to say, Im in the Army, Im not compensated as I feel that we should be for what we do, but it is enough and I have enough sense to properly budget my money to where im am not arrears on my bills.

2/18- Due to Chase customer service the Cashiers Check was canceled and another fedexed. They Claim they did not receive it, and I would be facing a late on my account if this couldn't be resolved. Last thing that I need is to take a hit on my credit behind stupidity so i asked what actions they wanted me to follow.

2/21- Holiday all banks closed.

2/22-Senate Federal Credit Union cancels one, and remits another, fedex to the same address that was given as the payoff address. In this they have tacked on an Additional $25 as it wasnt within the 10 day period. As well, initially it was attempted as a wire, but they gave incomplete instructions for posting a payoff so decided mail would be easier

2/23-Have fedex confirmation that they have received the item, good, so i should now be the owner of a tricked out 5.5 gen maxima. Call to follow up, the woman states give them a couple days and it will be posted to the account no worries.

2/26 Im awoken by the rudest person ive dealt with...at least, that is touching my money...demanding to know an update on my address, etc. Now im obviously perturbed and after updating, explain to the woman that on the due date you received over $7k from me. And your calling me TODAY 15 days later threatening me for $300. We go back and forth for a minute and she looks, and immediately begins to apologize. Heres the kicker.

They had the payment inprocessed on the 11th, remitted for processing...ON THE 18th...This of course was cancelled at their request, so it shows as paid in their system then reversed. So she apologizes for the inconvenience and asks when the other cashiers check will be arriving. i inform her that they signed for it via fedex on the 24th. She then informs me, "Hopefully we can find it and post it before we have to report it as a 30 day late on your credit report"

This will be the fourth car that ive financed in my LIFE. This will be the fourth car that Ive PAID OFF in my life, not bought outright cash, financed had a trans with a bank, built a history, never late...And due to the idiodacy of their processing i may take a hit on my credit due to these idiots.?.

Its a warning, maybe just one mans experience. Wish id have just went through my credit union like my first mind told me, but i used the dealers recommendation...sadly. I DO NOT RECOMMEND THEM, AND IF YOU CAN GO ELSEWHERE...DO SO!!!!

If Chase reports this as a late payment to the credit bureaus this may be a violation of the Fair Debt Collection Practices Act (FDCPA), and possibly state law as well. Unless the statute has been recently changed, each violation is punishable by a statutory amount of $1000.00 payable to you. If you speak with Chase again explain to the representative you are aware of your rights. There's plenty of info available on the web regarding this federal act. Additionally, once reported the credit reporting agenceies may be in violation of the Fair Credit Reporting Act (FCRA), but let's hope it doesn't get that far.

Be sure to keep an accurate log of important dates, i.e., when payments sent, cancelled, re-sent, conversations with credit union, Chase, etc. Equally important, and more obvious, is to keep all proof of checks, etc.

Chase will state it hasn't done anything improper thus far, and will argue even if it reports this as a late payment it's behavior is within the bounds of the federal acts. Kindly explain to the representative there is enough proof in their system to have a reasonable basis to believe there has been an error on their part and the reporting is incorrect. Request your account be noted each call you make, and maybe send a registered letter memorializing the situation so far.

IMHO, the goal here is not to go to court, rather, the goal is to force Chase to resolve this issue prior to any reporting. Once reported, it can be a hassle to remove, and there's no guarantee of success. Unfortunately, I have been through this with incorrect reporting for cell phone accounts I never had. Hope this helps.

Thanks, they are open now, ive been keeping a log of dates, and individual reps Ive spoken with. I went through a case of identity theft with my ex wife, apparently i rented an apartment worth of furniture in california, while stationed in new york and deployed overseas for 7 months. She rented stuff in my name, then moved, and they had put it in my name and under my social. No power of attorney or anything. Took over a year to fix. So i know the pain of trying to get a situation corrected AFTER the fact.

Im almost at the point of sending in another payment to just buy some time, but with just paying off my truck(January) and buying my house (December), i dont want to touch my savings and dont feel that i should have to.

Wow, sorry to hear that. I financed my first '02 through local bank, they couldn't have been nicer.

honestly, due to being lazy i ended up in the head ache. Ive been with usaa for quite some time, and this was prior to their current auto circle offering. I went in, and the dude cut me a deal with the lots "preferred" local finance option or whatever. All other new car purchases have been through the manufacturer or my credit union.
this is what happens when you stray from what you know.

My schedule was so stupid at fort lewis prepping to deploy (Im a BN Logistics Manager basically) and i never took the time to do it, and ended up dragging it and dragging it until here it is ive deployed and returned, and now this...sheesh

Trust me, I'm not looking down my nose when I say this, just offering my insight. If you were ahead on payments you can avoid all these red tape situations. If you were ahead by just one full payment , your next payment due is always going to be $0.00, sometimes for more than one month depending on how far ahead you are. That way if you're payment or payoff posts later then you expect, there's never a late payment issue, just maybe some extra finance charges brought forward, that you can typically argue your way out of if it was a payoff...

One of my friends went through some hard time recently. His credit union (who financed his truck) was willing to work with him, The bank financing his audio shop was willing to work with him, Chase, who had his ninja ZX1400 was not. Told him that he was already a few days late and it was sent to collections. It should be getting repo'd soon. The people at chase were extremely rude and not willing to help at all. He was highed T'ed off at everyone in the chase office.
