2008 w/cvt bogs when pressing gas then surges

2008 w/cvt bogs when pressing gas then surges
2008 Maxima 225k w/cvt
Runs fine for about 30 minutes then when I press the gas it bogs down then surges. Its like a delay between pressing the gas and acceleration.
If I turn the car off then back on it drives normal, sometimes for the rest of the trip.
If I put it in "sport mode" and manually downshift to accelerate then it drives normal.
In neutral it revs normal.
Seems like a transmission issue but has anyone had this problem before? and if you did, what was the specific cause?
