My Max got hit

my max got clipped when it was parked on the street, by a plow.. and now the insurance company and the town is denying it because apparently under NYS law, emergency vehicles arent liable unless they were driving wrecklessly (how you gonna prove that anyways), now im stuck paying $1500 out of my pocket for this...

heres some pics

if anyone knows anything i can do about gettin this paid for by insurance or the state, please let me know

That sucks. I think you should be able to get NYS to pay but the problem is that you are going to have trouble proving it. If you have proof then you might be able to do something. Good luck

did u see the driver do it? holy sheeeit that looks painful.
if u saw him then u can pull his **** over and get him out to exchange info (call the cops) yadda yadda yadda.

BUT if you "suspect" they did it..then u don't have a leg to stand on. call it a hit and run.

on a side note...i might have a brand new clear corner for the driverside for you.

Man that stinks...One of my favorite maximas too. Good luck on getting it taken care of. Just be sure to get a real good shop to do the paint work because I have seen green not match too well when some have done it.

yes he did hit me, yes the sheriff came and no accident report was made, but i've been dealing with their insurance company for the past 2 days and they are giving me the run-around that emergency (i.e. plows) vehicles arent liable for accidents... which is bull considering he hit a parked vehicle and i wasnt even in the damn thing

if the driver pulled up to your house than he's showing responsability in a way. You might be able to get something if you get the driver to sign like a written statement or something. Hopefully somebody in the law world on the org will help you out.

Man, I hate to hear that, you have one of the cleanest Max's I've ever seen. Good luck, I wouldn't even consider a plow an emergency vehicle. I can understand an abulance, police car, and fire truck, but plow.

yeah, call your ins. company, and tell them, they will probably go after the other company, and if you can get the driver to sign something that says he did hit your car,

Must be bad luck for black maxes this week...I was waiting to make a left when somebody creamed me from behind. 2 Minutes from home.My bumper is smashed and my trunk got pushed in a bit I cant close my trunk lid right now. Going to go get some estimates tommorrow. Hopefully I can get my body kit painted and some other things with the insurance money
