CAR GOT TOWED (long)

So I was off yesterday and got up real late, 11 am or so, I go outside to finish cleaning the engine bay, and did not see my car outside. SO I go around my apartment thinking I proly just parked it in the front, but no not there either. SO thinking it was stolen ran to the apartment building main office and asked the clerk did you tow my car. She ruffles thrue some papers and was like, do you drive an audi nissan maxima..

I was like no it's a grey nissan maxima, and she was like then yes. I looked at her funny and then asked, WHY?? and she said because it has no parking sticker. (I have just moved in to this place 2 moths ago and never had my car towed, there are no signs stating there is no parking with out a parking stiker, and management never even advised me of this.) So I was pissed. I asked for the manager and the cleark said she was out walking the apartments and if I leave my name and number she will get back to me, so I go out of the office and im just looking for this lady walking around the apartment.

when I find her (manager) she was like yea, you guys moved in after we gave the written notice in december so I will call the towing company to see if we can give you a discount, I said fine cuz I needed my car and you realy cant argue with the towing company and impund (learnd that a while back). So I get a 50% discount off the carges.

While at the impund the guy was like charges are 171.00, so I looked at him stupind and told him about the 50%. (manager had spoken to him earlier) he said no one spoke to him and that he could not give me the discount. ended up calling the manager at the apts and the tow truck driver to talk to this guys so he could give me the discount, he finaly agreed and said it was $90?? I told him half of $171 was not $90 and he gets mad at me . How the **** is $90 half of 171??

Jim (impound guy) said it was because of taxes, but when I saw the receipt it said 90 fee at 0% taxes, I told him I wanted him to charge me 85.50 plus tax and have it shown on the receipt, and he could not give me a reason why he could not do that exept that his system could not allow it, so I finaly just paid the $90 to get my car. went strait to the office and got a parking sticker, placed it on my car around 1:30 pm, I hate towe truck drivers .

She proly realized she messed up by towing a new tenant and gave me a 50% discount cuz that was her share

what the hell is an "audi nissan maxima"? you should have slapped her just for calling it that. and in the end, since you moved in after the notice, SHE should pay for any charges, not you.

I had something similar to this happen to me back in 2000. I had 2 cars (my 2G Max and an 87 Z24) I drove the Max daily, and parked the Z24 in an open spot. A few days later the Z turns up gone and I want to know what happened. Apparently I wasn't supposed to park it where I put it. Like you I was not told of the parking policy, and ended up dropping $180 to get it back.

My friends think I'm nuts when I try as hard as I can not to get towed when I park downtown or something. The owner ALWAYS get screwed over. I know your pain man. If I were president, I'd outlaw towing for anything other than people who park in red zones.

towing should be illegal unless it's an illegally parked car which then law enfocement tows it. tow companies kidnap your car and hold it for ransom. i don't see how that isn't theft.

That is abs -o- lutely criminal!

I would not leave this issue here, but go to court: If no legal NO Parking -sign, or written signed parking agreement statements by you, the los stupidos system creators owe you 90$ plus 500$ of expenses and pain.

Go now and tell u stupido mgr that this is going to be a court case, and shell surely hurry to give u money back, cause she knows she will lose via siberia...

I bet they did not give any receipt for u payment?

I don't know how it is in Sweden, but getting things like parking tickets and other petty "parking violations" to go your way in court is next to impossible. I got a $28 parking ticket in 2003 for parking in a spot that admittedly was marked, but never enforced, a spot that EVERYONE and their mother parks in to go to a local restaurant around the corner. This wasn't a red zone or anything, just a public street. Well this one time I parked there I got nailed (in like 6 months of parking there and never getting ticketed). I went to court to fight it. I showed evidence that my car got ticketed, even when cars parked 10 feet in front of me were in a red zone and DID NOT get ticketed.

I still had to pay up. The part of things like that is, it's not the $28 bucks that smarts, but the absolutely random enforcement, having to wait to fight it, and then when you're in court fighting it, basically getting blown off regardless of the evidence you present.

I don't want to make it seem like I went thru the Spanish Inquisition or anything, it's just the little civic things that **** me off.

Lawyers have here no big $ to be earned.

On public streets I can understand that one cannot appeal to how others get ticketed. But I still cannot get that u were ticketed if u park not against any regulation and/or No Parking -sign.

The original (here) story was on private property, if I am right? How on earth the truck company is allowed to play any role ? in legal penalties, thats random robbery. At least our everyman's robberies are state controlled...

I suppose Scandinavia is lots worse for a car owner, but this idiotic 'small corner' seems to be more 'user friendly'. Maybe time here for more advanced sicialismus development?

Still, to fight any issue here, one has to lose about all before you (maybe) get any benefit from legal fight. Any legal issue fight for u rights costs more than 6000$...

sf is horrible about tickets especailly now that they have a quota to increase the number of parking tickets they issue to increase revenue. They say it's not a quota, but when they say they want a 20% increase in revenue from parking tickets and don't increase the ticket prices the only way to do this is to issue 20% more tickets.

Anway, now I always put in 30 minutes more for parking than I need. I even do it when I just run to the ATM for a minute. These parking meter ladies are looking out for this stuff.

anyway if you can go to the landlord or whoever and get them to handle it out of court its cool. You can get your money back, i know i would.

In THIS, I have to strongly agree!! How da FLOCK is she charging YOU for HER F-up?? You shouldn't have to pay her (or the towing company, for that matter) a fcukin dime!!! Heck, if anything, they should pay YOU for your trouble. As a landlord (or landPERSON - to be P.C.), she's obligated to let ALL tenants be aware of any rules and regulations going on in their complex. I smell some underhanded BS floating around there, bro...

...a good time to garner the services of legal counsel.

There was actualy more than one car towed that night, the person ahead of me in the office lost his temper and yelled at the mngr, he ended up paying the full price, next morning I see his car with the same yellow numbering on his rear window as my max.

and at first the towing company did not want to give me a receipt, but since I wanted him to put the "Taxes" he was charging me on paper he did give me one. Like Winking said, it will cost more money for me to fight the issue than to just let it go, (court cost, time off work, geting new parking ticket downtown--our cops have to meet a quata here in houston too.)

Besides there having issues with the new Safe-Clear program, so they say towing companies wont be able to tow your car with out permision now,maybe.

lalo, its your money do with it what you want...........

im just saying that if you moved in after the written notice was given and you didnt get a written notice, they are obligated to give your money back and give you a written notice. you have a right to get your money back. I was saying just go to the place first to get your money back, just threaten legal actions. they usually cave in on a threat like that.

but thats just what i would do.
