I bought this issue of Hemmings Sport and Exoitc Car (which is a really awesome mag) for that little paragraph about our cars. Then I spotted your cardomain....

They did a good job at blacking out his plates though. I wonder if they stole this pic somehow without his permission.

That IS my car and a picture I took. It is down by the Port of The Dalles. One of the first pics I took of it, about 3 years ago. Obviously, it was before I added a single mod to it.
However, I never knew about that pic being in Hemmings until right now.
They stole the picture, but I am not sure from where. Possibly cardomain, but I believe I had it on keelan's website, too, I think (much higher resolution pic). I can't be sure because his site has been down for like 3 weeks. That's why there is no pic in my sig anymore.
Thanks for pointing that out. I definitely need to get a copy of that and also call them out on using the picture. I think if they find it on the web, it might be public information, but they probably should have the source somewhere in the magazine. Maybe there is info in the back?

Nope.. pictures posted anywhere on the internet are still copyrighted material, owned by the shooter (you), or publisher in the case of magazine shots and such.
there are some 'public domain' pictures out there with no copyright on them, but they're also stated as such on the website.
The point is, they did steal your picture and are liable to you for what they do with it. definitely contact them and say something about it. you might also want to call a lawyer if the magazine is going to be making any money off that picture- you'd then be entitled to royalties. dunno if I'd personally go that far with it since you're not tryign to make money off those pics, but when it all comes down to it, they're stealing from you and making money off of it.

Ok so i searched the mag upsidedown and backwards and I didn't find any source references. 17 out of the 25 cars seem to be brochure and manufacturer file photos. The rest of them look owner or photographer taken. But i know acouple of those they had stories on before/after this article and i was anixous to see if they were going to have a full story on that pretty red SE....
So what are you going to do Cliff? IMO, Call them up and make them run a story on our cars for using your pic w/o permission with no credit to you. B/C having that bit of notarity about our rides is worth more than money......

As long as the photographer is on public property while taking the picture they hold sole rights to the photo (not considering possible contracts)

(and considering the means which they found his pic, just asking/offering him a free copy for compensation/etc. is the least they could do. I'd be irked if I was in Chris's shoes not so much because of the permission, but because it was published and I didn't even know about it!)

First, I wouldn't have known about it if it weren't for this great community (.org), specifically, BuckFutter, who pointed it out. I seem to recall someone in the 3rd gen forum mentioning this article, but I don't think a picture or scan was included. Either way, I had no idea before this morning.
Second, I am not mad at all, since I have had numerous photos I have taken and articles I have written published in newspapers and magazines, so it's not like I care about the credit. I have either been paid or credited for my work in the past. I have done a lot of things for free, just because I like the work.
Third, I honestly didn't know the rules about "borrowing" stuff off the internet. My feeling is I put it out there on a public domain (cardomain) so I look at it like I am sharing.
Fourth, it's cool for me (and my car) along with the 3rd gens, to be featured in a magazine about our cars being collectible.
Fifth, I plan on finding that issue of the magazine ASAP and contacting the editor and possibly the publisher, just to tell them what I am writing here.

I emailed the "customer liason" for Hemmings. I suspect the place is shut down for the holiday, but hopefully, I will hear back from them next week sometime. I will update if I get any reply.


Looks like the same pic, BUT IIRC the changes they made (blacked out plate and lightened the pic) eliminate the copyright issue since they modified the pic. My wife mentioned something about that a few years back when I was working on a logo.

damn, that's insane. i was looking for that issue at fred meyer after the original thread here saying the 3rd gen was featured. the next month's issue was already on the shelf though. that's pretty cool imo, i'd feel flattered as all hell.

hell, id keep the car now.. it is famous......it has to be his car, even he dam head rests are set the same way......they edited it for the color because if they printed it in the paper that dark, it would look like crap, or it wouldnt show up right at all......so they had to lighten it..... trust me i learned t his in my print shop class in high school.......id get some money out of them dude......the background is even the same.... so they cant say it is yours......
I haven't decided if I am keeping the car or not. If someone wants to pay me a certain price for it, I have some other plans in mind. Might fall through. I have only had a couple of people show interest. I guess these cars aren't as collectible as the magazine thinks. Otherwise, I am very happy with it and don't mind keeping it.
Yes, I know the original pic was too dark. I kind of liked it that way on that particular picture. I felt that it made the paint seem more glossy.

OK, I got a response today from Hemmings. Actually, I got an email from Craig Fitzgerald, the guy who wrote the tidbit about the Maxima and is now an editor at the magazine.
He was extremely nice and offered to send me some back copies of the magazine and a current issue, along with a correction in an upcoming issue with my photo credit. I told him they didn't need to credit me on the shot, just credit me if they use it again, and I would gladly take a couple of back copies.
I had mentioned in my email to him how I thought it was cool someone recognized our cars as being a potential collectible and he responded with some nice words including, "Nissan has been a disappointment to me ever since they dumbed the Maxima down, and went with goofy styling rather than the clean lines of the third-gen car."
That is an exact quote from his email and a sentiment I am sure most of us 3rd gen owners agree with.
