I think the bigger issue is that it isn't right, not whether or not he could sue. That's kinda rediculous for just a little eBay auction. It's more aobut the principles... I just wanted to clear up the issue of the legalities. Like Matt said, the pic is copywrited from the moment it is taken, even digitally.
