A sad, sad Maxima story

I guess alot of you 4th Gen owners may remember me coming in here and posting that I was the now proud owner of my first car, a Rosewood 1997 GXE. Well, I am now here to share my sad story.

I bartend at a night club/bar, and about 1 month ago someone decided to jump onto the roof of my Maxima and caused $4000 worth of damage. I got the whole care repainted, and it was looking sharp. I picked it up one week ago today.

Yesterday afternoon my girlfriend had my car and got into an accident. She is okay, but very bumped and bruised and you can never tell what kind of long term damage can be done to someone's spine in an accident like this. The accident was in no way her fault. She was about to merge onto the highway and was accelerating to do so. And from four lanes over (the left hand passing lane) some chicks car came spinning across the highway right in front of her. The worst part is she is very emotional cause she just got into another accident that wasn't her fault in her car 1 month ago, and it was totalled.

Now, from the cars point of view, considering the speed it could have been a lot worse. There is pretty extensive damage to the front passenger side corner, and the hood is slightly folded. All the damage appears to be cosmetic, but who knows. Including labor, I'd be shocked if it was under $5,000 CAN.

Here is the kicker, but this part I'm not sure of yet. In Canada we have some crap called no fault insurance, and without going into too much detail, this could cause a problem. I heard from someone that its likely that people under 25 (she is 21) are not covered by my insurance which means.... well I don't really know what that means, but she'll probably have to pay for the repairs out of pocket, and hopefully I won't get into trouble. The money should later be recovered in a lawsuit which is most definetly being looked into. I meant to take photos, but I didn't really have a lot of time at the towing lot, and I wanted to get back to comfort my girl.

Not to put down your Max, but it sounds like it's jinxed. Maybe you should look into getting another one...

Hmm, interesting theory.

That reminded me that in the first two weeks of ownership, I managed to have a rock on the highway put a hole in my condensor, and therefore negate any chance of air conditioning.

Oh yeah, and the day after my girl totalled her car, I was on the highway with her getting some stuff done for her work and we blew a tire in my max, which scared the **** out of her.

you need to confirm with your insurance. Also if she has insurance on her own car then you may have to claim against that.

No fault insurance... So nobody ever gets singled out for blame? Your own insurance fixes your own car? Whatr about these major whipelash lawsuit? sue your own insurance?

You should check the laws. No fault insurance usually means if you were not insured and hit someone. Where it's not her fault, the accident, you need to find out if she is covered under your insurance. Not in this particular case, just in general. I think you will be okay. Unless of course the car that hit her is not insured, then its a major problem. Find out more of the facts and we'll see if we can help.

I remember you, you are the one that asked around about a used Maxima...and I was there to post my price when I got mine.

About the car, I don't know what's your stand point with superstition ans stuff....but I would get rid of the car at once. It seems that it just "doesn't work" with you..... proven by repeated things that happened to it.

I am sorry about your gf....definitely get her scanned.... man, she is only 21 and has to go through 2 accidents and tire mishap (knock on wood).

I could read that other .org members have posted their opinions and you might want to follow them. If I were you, lawsuit would be in order as well. Sorry about your current state of affairs though.... I know it's not fun at all....

Kyle;

If you are younger than 25 and/or there's no specific exclusion of drivers under 25 on your policy (and your g/f's licence isn't suspended and she was driving your car with your permission), then any decent insurance company in Ontario should take care of everything with no problems.

The same is true if you pay for "uninsured motorist" coverage (about $15 a year) and the other driver has no insurance. Check your policy.

Did the police suggest that your g/f get checked out or did an ambulance come to get her? Either way, the other driver is in danger of a lawsuit from your g/f.

You may also want to post your sad story in the Canadian Forum here on the org - we have one or two "constables" as members and I would guess that the other Org members from the GTA may have some insight as to the workings of the insurance industry in Ontario, as well.

Some more info:

- My girlfriends injuries were included in the accident report (this is crucial for potential legal action later). We are going to keep a journal of any pain, loss of mobility, or work missed (she is a high income earner, six figures, so this is significant).
- Her insurance policy was cancelled cause she was yet to buy a new car after totalling hers.
- I do believe the other driver was insured. She was an 18yr old female.
- My girl left the scene of the accident in an ambulance.

To be perfectly honest, and it is weird to say this in a car forum, but I don't really care all that much about the car at this point. I'm just glad she was okay. The car ended up in the second from left lane of the highway, and if all the other drivers on that busy highway weren't paying attention, she could have been killed.

A car can be replaced. My girlfriend can not.

Hey Kyle,

Good to hear both of you haven't been seriously hurt by what's happened.

I can definitely understand what your gf is goin through. I went through a rough spot in my early driving years as well. Two accidents within 6 months made me quite the anxious and nervous driver for a while. But here I am, 10 years later and haven't had so much as a speeding ticket since. Things will get better.

I'd get rid of that car though. After two major accidents, it's not worth fixing. It'll never be as structurally secure as it should be.

It hasn't been in a single major accident. From what I can tell by looking at the car, the damage this time is cosmetic. And last time it was fixed, it was cause the roof got jumped on and dented badly. It was pushed out and repainted.

I'm not sure anything has happened to the car to change its driving dynamics.
