To change or not to change? Mother of all questions

I noticed jerkiness in shifting at my automatic especially when I reach slightly before 40 mph on the gauge with a delay reaction and then the strong pull shift from 1k to 3k rpm when i hit the gas more (also today i noticed alot more jerkiness on various other occasions), but when I press OD OFF button, it all improves and no jerkiness. My brother says it's useless to change transmission oil if you never did it before (88k mileage now)... is he correct, is my transmission on a mission to get fukkked soon? Only time can tell perhaps... Please provide any useful feedback...
maybe its good timing to start selling the car? transmission is expensive... also wtf is with these cars my gas mileage is totaly screwed i filled entire gas tank yesterday, drove 115 miles, now its below middle level.... man I had honda accord and no such problems with anything and twice the mileage i had on that car... sorry but i m just mad cause I got major pickup/acceleration problems in this car... seems like a bicycle got better torque and acceleration than me
