Maxima is no more...

Driving to Hampton beach on Tuesday...I was sitting at a dead stop in traffic when I see in my rear view mirror a big a$$ Ford Explorer comin flyin at me,and hit me dead on from behind at 70-75mph. Maxima got thrown into the guard rail and into middle lane of traffic.Maxima's totaled,I just got outta the hospital,still have whiplash,bruised ribs and fractured elbow,but i'm ok. Luckily I was alone in my car and no one else was hurt...Explorer had a VERY minor scratch and the car in front of me had a small scratch...So now I guess I'm gonna start to part the Max out...all aftermarket things can go,but not many stock parts until i get it back from the junkyard...the car is still in my driveway,so i can at least get the aftermarket stuff. Look for post in For Sale section called "Totaled Max: Part Out". Nice bein' on the .org but time for a truck or somethin....pics will be up later today.

Are you saying you got hit at 70 - 75MPH? I would like to see pictures. You are lucky to be alive.

What would possess you to want to buy a truck if you lived through this accident? Isn't that a testament to Maxima's ability to withstand a considerable impact?

Take your time on deciding what to do if you can. I would be inclined to hang on to the aftermarket parts until I was 100% sure I wasn't going to buy another 4th Gen Maxima. Why do you want to trade for stock parts if the car is a write-off? What do you need them for?

Whatever you do, keep fuel economy a consideration in mind as we are in for high oil costs for some time to come.

RMURDOCH: well i have no clue what happens from here on out...its a write off? whats that mean? never gone through this before.car's totaled and havent gone through insurance yet,so the cars in my driveway.calling insurance today,getting it appraised (totaled) then dont they take it away to a junkyard? I'm lost after it's appraised...fill me in though!!

Guessing by your injuries, you car is totalled. I walked away from accidents that totalled my car. But on the other hand, if the dude was actually driving 75mph, his truck would be toast. By the time he hit you, he was probably going 45mph or so.

See what the adjuster says and then decide what to do. Won't take but a day or two. But make sure to haggle the amount they want to pay you for the car. 1st offer is just that, an offer.

Insurance works differently where I'm from. In British Columbia, if a car is paid out the insurance (province run) will pay out the owner and they keep the car. However, the owner can buy it back from the insurance company for a reasonable price and do whatever they want with it.

From what I gather, in the US (not sure if its always the case) you get paid out and keep the car. Correct me if I'm wrong. Consequently if you're going to part out the car you do not need the stock parts in exchange for aftermarket parts. Just maximize your cash flow from the vehicle otherwise you are then going to have to dispose of more stock parts, and who needs the aggravation.

Her insurance is going to be affected because she ran into you. Will her insurance go up more if the payout is higher as a result of being sued? I don't think so. And if so, she should change insurance companies.

You aren't suing her, you're suing her insurance company that's what insurance is for. Talk this over with her, emphasize its nothing personal and sue the insurance company. An ambulance chaser can explain all this to you and they generally work on a contingency basis, ie. a % of what is recovered for injuries.

One thing you should be aware of: whiplash injuries sometimes take quite awhile to get over and often manifest themself some time after the actual accident. Again don't sign anything. Talk to an ambulance chaser!

Find this out and don't sell anything. Like I said you might decide on another Maxima and have all the aftermarket parts you need to get you going. The insurance company won't pay you much for them.

They will give you the option of buying the car back. It is usually a very low price for the car and they will still give you money but not as much. That is basically how it works. They don't just let you keep it though.

Yeah they give book value but I don't think they give extra for aftermarket parts.

Another thing you should do is start a daily journal and make notes of how this accident has affected your life, ie. pain, suffering, anxiety, emotional disturbance etc. etc.

I am not a lawyer, but my wife is a legal assistant and has several years of personal injury experience. Trust me on this one. Start a daily journal and make notes of all the trauma, discomfort etc you have experienced. The ambulance chaser will want it and you should keep it up until the matter is resolved.

You could always pay your friend some money under the table from the insurance settlement (not from the car proceeds) so she isn't way out of pocket.

i know the person who hit me,talking to them she said "i panicked and let go of everything"....maybe it was 65-70? it was whatever speed she was doing on the highway. and why is this turning into an argument?

It's turning into an argument because unless she was driving a Mac Truck she would have more then a scratch on her bumper after hitting you at 65-75 MPH. You would also have a trunk pushed in a lot more then that one and your quarters would more then likely be crunched in. So she must have been going like 40 because that extra 20 MPH would have caused you to slam into another car too.

It's not. Given that you have another reliable car don't be in any hurry to settle this matter. Is it against the law to have no seatbelt on where you're from? If they don't know you didn't have it on, I would be silent on that because it would ultimately affect any injury payout you might get.

You're being your own worst enemy with respect to this accident as far as I can see. Have you talked it over with your parents as to how you should proceed?

It seems like you're stumbling around in the dark and need some guidance.

I was merely trying to give this kid some sound advice as he obviously doesn't have a clue what he was doing. Let's not get personal guys. If you have been through an accident and injury yourself, give the guy your best advice! Don't question his account of the accident. Don't flame people trying to be helpful. It's just not productive.

My personal advice: Speak to a lawyer immediately. You don't have to do ANYTHING if you don't want to. But get some legal advice before you do anything. Do not speak to the insurance company with any details about the accident, your injuries, etc, until you talk to an attorney. Again, you would NOT be suing the girl. You would be suing her insurance. Her insurance will cover the damages, hospital costs, and any settlements from a lawsuit. If you have future back troubles and need physical therapy, her insurance should be the one paying for this, not you just because you felt bad that you knew the girl!
